The general contractor, Rob Zuli, presented plans for the construction of a portico, deck, and patio within the 100-foot buffer zone. The commission emphasized the need for erosion control measures and limited disturbance footing to minimize environmental impact. A negative determination with standard conditions was decided for the patio, with a wait-and-see approach adopted to monitor runoff and erosion.
The commission tackled the issue of buffer zone work proposed by Dutra Batello for his backyard at 59 and Carile Street. The commission stressed the need for professional consultation and suggested a site visit to evaluate the area intended to be leveled for a safer children’s play space.
Updates from the Planning Board were also part of the meeting, with closures of two projects and discussions about the Chelmsford outdoor lighting bylaw and new projects in the pipeline. The potential impact of the development on the hydrology of the Vernal pool was a topic of concern, with the commission acknowledging the need to focus more attention on this aspect. Public concerns included the potential impact on water drainage, the National Heritage line, and the loss of trees in the buffer zone.
The meeting also addressed the potential transfer of properties from the town to the commission, including the Warren Pole, Sunny Meadow, and Shean Farm properties. There was debate about the use of these properties, with contrasting views on whether they should be used for passive recreation or agricultural activities. The potential transfer of five undevelopable parcels due to significant wetland resources was also discussed.
In other matters, the commission discussed an enforcement issue regarding unauthorized construction in the buffer zone, which had led to a cease and desist order by the building inspector. The progress on the Freeman Lake surveying and deed research was reviewed, with a recommendation for a title exam to confirm the town’s ownership. A certificate of compliance for a property on Conquered Road was approved after confirming it met all conditions.
