- Meeting Overview:
In a recent meeting of the Cocoa Beach Special Magistrate, a significant case involving KT East Coast LLC was discussed, where the respondent had been found in violation of city codes. The special magistrate approved an agreement to reduce the respondent’s fine to $16,500, despite the respondent’s dissatisfaction and claims of improper notification. This resolution occurred alongside other code violation cases, including one involving Jennifer Murphy, who came into compliance, and Joseph Green, who was granted an extension to remedy a fence violation.
The meeting, presided over by Special Magistrate Lonnie Groot and Clerk Danielle Crawford, focused on KT East Coast LLC’s violations and the accompanying fines. The case attracted attention due to the respondent’s claim that they were not properly notified about the violations and had addressed the issues promptly once notified. Representatives for the respondent, Mr. Goldman and Mr. Amos, argued that a code enforcement officer had informed them that the fines had been halted. The city stood by the agreement to reduce the fine.
During the proceedings, there was a debate concerning the authority to reduce fines. The special magistrate clarified that the city council, not just the magistrate, had the power to adjust fine amounts. The respondent’s representatives expressed frustration over the process and the financial impact of the original fines on their business. Despite these concerns, the special magistrate entered an order to implement the agreement between the city and KT East Coast LLC. The respondent was advised that they have the option to appeal to the city council to seek further reduction or elimination of the fine.
The situation with KT East Coast LLC was not the only matter of compliance addressed during the meeting. In the case of Jennifer Murphy, the city presented evidence of a city code ordinance violation. The respondent had since come into compliance, and the city was not seeking a fine. However, a caveat was placed that a double fine could be imposed for any future violations. Murphy made a statement regarding her efforts to comply with the codes and mentioned her intention to sell the property.
Another case involved Joseph Green, who was facing a fence violation. An agreement had been reached before the meeting to extend the compliance deadline to April 24th. Green’s attorney detailed the attempts made to comply with the city’s regulations. An order was entered setting the new compliance date, with a stipulation of a $25 per day fine to be imposed if the violation was not corrected by the agreed date. During this case, a brief moment of disorder occurred when an individual attempted to speak out of turn. The magistrate promptly addressed the interruption.
