Cocoa Beach Special Magistrate Reduces $111,675.45 Fine to $2,746.70 for Longtime Non-Compliant Vacation Rental.
- Meeting Overview:
The Cocoa Beach Special Magistrate meeting focused on two primary cases involving significant code violations. The meeting’s most notable outcome was the city’s decision to negotiate a substantial fine for Isabella Raymond, who had operated a vacation rental without proper permits for over six years. Originally facing a potential fine of $111,675.45, the city agreed to a reduced amount of $2,746.70, provided certain conditions were met. Another case involving property code violations by Patricia Hayes resulted in an extension for compliance due to her mobility issues.
The primary case centered around a property on Esther Drive, owned by Isabella Raymond, who had been running a vacation rental without the necessary registration or business tax receipt since December 2019. The city discovered the unregistered operation in January 2025, leading to a notice of violation being issued. Despite initial efforts to comply, Raymond failed a life safety fire inspection and continued operating the rental, resulting in citations totaling $350.
In December 2025, the city posted additional citations at the property. Raymond missed a scheduled fire reinspection, incurring a $250 no-show fee. The city calculated a potential fine of $111,675.45 based on city code violations but proposed a reduced settlement of $2,746.70, which included fees for two years of certificate of use, two years of business tax, a new application, and a late fee. Raymond countered with an offer of $1,396.70, which the city deemed insufficient given the duration of non-compliance.
During the hearing, Raymond did not dispute the evidence presented against her, which included screenshots of the vacation rental listing. She did express confusion regarding the fees and the timeline of notifications, citing difficulties accessing city resources and a lack of received invoices. Raymond acknowledged her responsibility for the unpaid local business tax and rental registration fees, stating her intent to resolve the issues and expressing a willingness to pay the outstanding amounts.
The magistrate emphasized the city’s leniency, noting that it only pursued business tax fees for the past two years, despite a seven-year period of non-payment. The magistrate clarified that certain fees, such as the no-show fee for the fire inspection, were beyond their jurisdiction and determined by other departments.
The magistrate concluded the order would reflect the agreed-upon facts, with the city seeking payment for two years of unpaid business tax and a single citation for the rental registration fee.
In a separate case, the magistrate addressed ongoing compliance issues at Patricia Hayes’ property on Burllo Lane. The property faced violations due to tall grass, trash, debris, and obstructed emergency access. Hayes, who was not present at the meeting, had previously received multiple notices dating back to July 2025.
The representative noted that Hayes’ mobility issues complicated her ability to maintain the property, with family members assisting in cleanup efforts. An extension for compliance was granted until April 1, with a subsequent hearing to determine any fines for continued non-compliance if the property remained out of order.
The magistrate confirmed the property’s violation of cited codes and granted the extension, stating that failure to comply by the deadline would result in a Massie hearing to assess daily fines. The meeting concluded with no further matters presented by the city.
