Crow Wing County Board Mulls Rezoning and Land Use Changes Amidst Community Concerns
- Meeting Overview:
The Crow Wing County Board of Commissioners convened to address a series of land use and zoning applications, most notably a proposal to rezone a residential area for commercial use, discussions about shoreline vegetation buffers, and the affirmation of a staff decision denying a building permit based on historical restrictions.
A significant portion of the meeting revolved around a rezoning request aimed at transforming a residential area bordered by County Road 3, Wise Road, and Riverside into a commercial zone. The applicant argued that the property’s high-traffic location, surrounded by three county roads, made it better suited for commercial use. The proposal hinged on the presence of a planned roundabout intended to enhance traffic flow, which the applicant believed would attract commercial interest and stimulate economic growth. They asserted, “This is the highest and best use I believe as a commercial use,” suggesting it would boost the tax base and create jobs.
Despite the applicant’s optimism, the proposal faced considerable opposition. Board members expressed mixed reactions, with some questioning the necessity of additional commercial zoning, especially given the area’s historical residential character. One commissioner remarked, “I do not see a need for additional commercial property. There is commercially zoned property to the north.” The board received five public comments opposing the rezoning, reflecting community concerns about preserving the area’s residential nature. One resident, even while on their honeymoon, took the time to voice opposition, citing the availability of nearby commercial amenities, such as gas stations, as sufficient.
The discussion revealed a divide between development aspirations and community preservation. The highway department expressed concerns about the potential impact on the forthcoming roundabout, emphasizing the need for collaboration to mitigate traffic issues. The applicant countered by highlighting the versatility of potential commercial developments and the site’s strategic location.
In parallel, the board engaged in a detailed examination of proposed changes to the county’s land use ordinance, particularly regarding shoreline vegetation buffers for natural environment lakes. Public input was sought, with residents voicing strong opinions on the potential weakening of protections for these sensitive areas. Jerome Brown and Brenda Sharpier from Mission Township both stressed the importance of maintaining vegetative standards to prevent erosion and protect wildlife habitats. They argued against replacing specific terms like “trees, shrubs, undergrowth, and woody vegetation” with the more generic “vegetation,” fearing it would lead to less effective environmental safeguards.
Board members discussed the necessity of maintaining clear and robust protections, especially for undeveloped lots along natural environment lakes.
Simultaneously, the board reviewed an appeal concerning a staff decision to deny a building permit for a lot deemed non-buildable due to historical restrictions dating back to 1971. The appellant, represented by attorney Jeff Scott, argued that these restrictions, not recorded on the property’s title, were outdated and should not impede current development. Scott emphasized that the lot’s unique access situation did not violate the original intent of the restrictions. However, the board maintained that their role was to assess whether the staff’s decision adhered to the ordinance and the historical record, ultimately affirming the decision.
The meeting also addressed various variance requests, including those from Lakes Premier Storage LLC for a commercial storage facility and Chad and Jessica Foster for a bluff impact zone setback. Both proposals were scrutinized for their compliance with existing regulations and potential community impact.
