Debate Over Outdoor Pod Storage Dominates Hainesport Land Use Board Meeting
- Meeting Overview:
In the latest Hainesport Land Use Board meeting, a proposal for outdoor pod storage took center stage, sparking discussions about zoning compliance and operational needs. The board also addressed various other matters, including a request for a bulk fence variance and a zoning ordinance amendment targeting data centers.
The meeting began with a focus on a proposal from NJ Exit 5 Industrial Berry Owner LLC, seeking a use variance to stack pod units at their storage facility. The request marked a departure from a prior interpretation of the zoning ordinance, which allowed empty pods to be stored without stacking. The current plan proposed stacking the pods three high, prompting the need for a use variance due to its classification as outdoor storage.
Richard Wells, representing the applicant, presented the request, emphasizing the operational necessity of increasing outdoor storage capacity from 115 to 315 pods. The board was informed that the facility maintains a backstop of 300 pods on-site during peak seasons, with additional pods transported to nearby hubs to manage overflow. The stacking process involves specialized equipment capable of handling the weight and ensuring safety protocols are followed, especially during storms when the stacking height might be reduced.
Concerns were raised by board members about the visual impact and compliance with zoning regulations. A professional planner argued that the proposed changes would enhance compliance by improving stormwater management and minimizing visual disruptions. The planner noted that the site had engaged in outdoor storage since 2011, which set a precedent for the current request. However, board members questioned the potential precedent this approval might set for future requests and expressed concerns about the lack of explicit plans for a newly paved area intended for future use.
The dialogue highlighted a fundamental disagreement between the need to uphold zoning regulations and the applicant’s operational requirements. Despite the applicant’s assurances that the changes would not alter the site’s use, the board remained divided on whether the proposal aligned with zoning purposes. Ultimately, the board considered a motion to approve the variance but acknowledged the complexities involved, including the need for further testimony and review of the implications for the site plan.
In addition to the pod storage debate, the board addressed a request for a bulk variance from a resident, Mr. Chen, who sought to increase a portion of his fence height to six feet to secure privacy for a pool under construction. The board reviewed photographs of the property and confirmed that the proposed fence would not interfere with sight lines or neighboring properties. With no public objections, the board approved the variance, noting prior approval from the Homeowners Association.
The meeting also covered a proposed ordinance amendment to define and prohibit data centers within the township, reflecting growing concerns over water consumption and noise associated with such facilities. The board approved the ordinance, noting its consistency with the township’s master plan, which did not specifically address data centers.
Further deliberations included an extension request from EM Motorcars and the withdrawal of a development application by Verizon New Jersey. The board noted ongoing issues with Verizon’s site, including unresolved violations dating back to 2014. This withdrawal allows the township to potentially resume violation actions.
The board also authorized a preliminary investigation into areas in need of redevelopment, responding to a request from the governing body. This step marks the beginning of a series of studies and discussions aimed at identifying and addressing redevelopment needs within the community.
