They noted that other businesses with similar street exposures, like Central Market and Ace Hardware, complied with regulations without needing variances. These businesses set a precedent that challenged the applicant’s claim of unique circumstances.
Despite these arguments, supporters of Zorbas, including Jeff Bame from Lighthouse Construction, highlighted the restaurant’s historical significance in the community, operating since 1969. Bame argued that some proposed signage could be considered artwork, not traditional advertising, pushing the commission to reconsider its definitions. The debate on whether certain elements of the signage could be classified as artwork rather than a business identifier added complexity to the deliberations.
The variance discussion continued with commissioners expressing varied opinions. Some saw merit in the proposed artistic elements and the potential enhancement to the area’s visual landscape. However, concerns about setting a precedent that could lead to further requests for exceptions to signage regulations were prominent. The commission ultimately approved the variance, deferring to the applicant’s arguments.
In a separate discussion, the commission turned its attention to amending zoning ordinances in response to new state laws permitting cannabis cultivation and manufacturing. The proposed amendments would regulate outdoor cannabis cultivation in residential agricultural districts, with conditions such as a minimum lot area of 200 contiguous acres and setbacks from property lines. The ordinance also addressed the prohibition of retail sales and manufacturing activities on cultivation sites.
Concerns were raised about the practicality of the proposed regulations, particularly the feasibility of finding 200 contiguous acres within city limits. The need for a zoning map to identify potential locations for cannabis operations was emphasized. Discussions also highlighted the importance of odor management, a concern not fully addressed in state statutes, but crucial for nearby residential communities.
A suggestion was made to allow micro-cultivators to operate within B2 zoning areas, with a square footage limit to facilitate a viable business model. The commission acknowledged the potential educational and consumer engagement benefits of such operations, as noted in other states.
The urgency to finalize the cannabis ordinance before the January 1 deadline for license applications was stressed, with participants urging proactive measures to ensure local regulations are in place.
