Another discussion involved Noah Auto Body Repair and Sales Inc, represented by Attorney James Nyman, who provided updates on the business’s operational status. This matter had been continued from the April meeting due to prior compliance issues related to sales hours and business activity. Nyman submitted an affidavit from the manager, Raymond Desmoures, detailing a minimum of 30 hours of operation per week. He acknowledged challenges with sales, attributing difficulties to competition from a neighboring business. The board noted an increase in the number of cars on the lot compared to previous inspections. Nyman presented various documents and photographs to support claims of improved operations, though issues with the neighboring business remained unresolved. The main focus was on compliance with the sales license.
The commission also revisited the case of Partners Inc DBA Antonus at the Beach, represented by Fernando Lissa, who addressed violations related to unauthorized ownership transfer and the lack of an approved license manager. The commission received correspondence from Lissa’s attorney indicating that most compliance items were nearly complete, with only the Department of Unemployment issue pending. Lissa explained efforts to rectify previous payroll issues and had recently submitted a request to update his unemployment status. The board expressed concern that the process had been ongoing since 2021, noting a pattern of delayed compliance. They stressed the importance of maintaining proactive communication with the License Commission to avoid last-minute resolutions.
Moreover, a business owner expressed frustration over challenges in obtaining necessary licensing and documentation. The owner highlighted bureaucratic hurdles and insufficient support from his legal assistance. He recounted difficulties in acquiring a certificate of good standing due to outstanding taxes, despite having established a payment agreement. He noted significant personal investment in resolving these issues independently, stating, “I spent over $5,000 already with something that was supposed to be done like this.” The commission granted an additional 30 days for the owner to complete the necessary paperwork, emphasizing timely action.
In another item, the commission addressed a hearing related to PK and E Corp doing business as BK’s Bar and Grill. The discussion centered on unauthorized transfer of ownership and the absence of an approved license manager. The assistant manager, Bob Kelly, who had been acting in a managerial capacity, applied for the official position of manager. However, complications arose from the recent passing of the previous owners and pending probate court matters. Legal representatives mentioned ongoing efforts to rectify the transfer of stock, which was still caught in probate. Kelly spoke candidly about the personal challenges following his mother’s passing and acknowledged his struggles in managing the business. The commission suggested Kelly provide a status report within 30 days, scheduling a follow-up in 60 days to ensure the issues did not stagnate again.
