She contended that the proposed amendment would fit within an existing employment and service cluster, adjacent to current HCLI zoning, and was consistent with the county’s comprehensive planning objectives.
Despite Bush’s detailed presentation, which included compatibility analysis and evidence supporting the rezoning, a divide emerged between the applicant’s position and staff’s concerns regarding compatibility and the appropriateness of the proposed zoning. The board members acknowledged the need to objectively evaluate the criteria while considering public input, reflecting on the community’s evolving needs.
Another issue arose during the meeting concerning discrepancies in visual documentation. A board member identified an error in the presentation materials, noting that two images did not accurately represent the applicant’s property. This misstep raised concerns about proper notification procedures and public perception, as the visuals are important for informing the community about the meeting’s agenda.
In response to this issue, the board sought legal counsel, who recommended that the hearing be continued until the correct visuals and signage were provided. The attorney underscored the importance of adhering to procedural requirements to ensure adequate public notice. Consequently, the board passed a motion to continue the hearing, agreeing that the county would cover the costs of rectifying the error.
The board also considered a small-scale map amendment application, case number SSA 202507, for properties at 6490 and 6505 Highway 29 North. The proposal sought to change the future land use designation from rural community to mixed-use urban. Meredith Bush, again representing the applicant, argued that the downzoning of these properties in 2015 constituted a legal taking of property rights. She explained that the proposed amendment was necessary to restore development rights under the county’s savings clause within the land development code.
Bush’s presentation included environmental assessments, traffic data, and utility availability. She also noted that the applicant voluntarily limited certain heavy industrial uses to avoid negative effects on the local community. Staff supported the amendment, and the board approved the motion to carry forward with the proposed changes.
