Fall River Zoning Board Approves Variances for River Investment Properties Project
- Meeting Overview:
The Fall River Zoning Board of Appeals approved several variance requests during its December 18, 2025, meeting, including an application by River Investment Properties LLC to modify a non-conforming structure on East Main Street. The board also addressed other significant variance requests and discussed future meeting logistics.
The most notable development was the board’s approval of River Investment Properties LLC’s revised proposal to replace a proposed six-unit apartment building with three townhome-style buildings. The initial plan had been met with concerns over its non-compliance with zoning regulations. Represented by Peter Beamis, the applicant presented a revised plan that improved compliance with zoning regulations, including front and side yard setbacks. The proposed adjustments increased the front yard setback from a mere tenth of a foot to 9.1 feet, and side yard setbacks to 8.2 feet and 9.7 feet, addressing previous non-conforming conditions. The building coverage was also reduced from 71.7% to 23.9%, with impervious coverage decreasing from 72.3% to 66.5%.
Parking was a focal point of the discussion, as the applicant sought relief from strict parking requirements. The plan proposed 11 parking spaces, surpassing the six spaces mandated by zoning regulations, without reducing green space. The board unanimously supported a variance for a 10-foot rear yard setback and a special permit reducing parking size requirements. Concerns about neighborhood compatibility and the potential future addition of an accessory dwelling unit were also addressed, with assurances provided about compliance and transparency.
Another topic was a variance request by Charles J. Ogara to construct a single-family dwelling on a non-conforming lot previously part of a parking lot. Despite opposition from the Corki Road Club and the Corki Road Neighborhood Association, who voiced concerns about exacerbating parking issues, the board approved the variance with a condition prohibiting further accessory dwelling units on the property.
In the realm of new business, Primos Property Management LLC received approval to convert an existing automobile repair facility into a commercial warehouse for a party rental business. The discussion centered around operating hours, storage conditions, and signage limitations. The applicant assured the board that all storage would occur inside the building, with only operational vehicles parked overnight. The board approved the variance request under these conditions, emphasizing the importance of maintaining the neighborhood’s character.
The board also considered a proposal from Dale Street Realty Trust to subdivide a property into two lots, a move intended to merge the parcels with adjacent properties, thereby enhancing their size without introducing new construction. The board supported the proposal, contingent on a condition preventing future subdivision, which aimed to preserve the character of the neighborhood.
Among the evening’s final topics, the board addressed an extension request by 37 Park Street Partners LLC for a previously granted variance and special permit. The request, driven by potential property sale negotiations, was approved, with members noting a recent economic development bill that granted an automatic two-year extension for permits.
The board concluded with a discussion on changing future meeting times from 6:00 PM to 5:30 PM to align with other city boards. After brief deliberation, the board voted to approve the change.
