Falmouth Conservation Commission Deliberates on Marina Dredging and Compliance Issues

Environmental considerations are integral to the dredging project. The shellfish constable suggested mitigation measures, including the donation of shellfish seeds and supervision of shellfish relocation during dredging, funded by the applicant. A silt curtain will be utilized to contain siltation, protecting shellfish and wildlife. Concerns about sediment transport were addressed by noting that the water circulation at the site is largely restricted by the bridge opening.
The commission also reviewed a compliance issue involving unauthorized construction on Kerry Lane. The applicant, Donna Habber Kornberg, sought after-the-fact approval for a pool, deck, and masonry wall, among other modifications. Raul Lisardi presented the case, noting that the project aimed to demonstrate adherence to current regulations while protecting wetland resources. However, the as-built conditions included deviations from the original order, such as a five-foot bump-out of the deck and a wall in a different location than approved.
The commission debated whether the as-built conditions maintained adequate separation from the buffer zone and if the proposed native plantings could mitigate environmental impact. Attorney Brian Wall supported maintaining the current conditions, arguing they better protect wetland resources than a complete site reconstruction. However, concerns about setting a precedent for approving deviations from approved plans were raised, emphasizing the need for regulatory compliance.
Public comments, including emotional appeals from neighbors, highlighted the human element of the regulatory process. One neighbor expressed concern that any prolonged reconstruction would negatively impact the elderly homeowner’s quality of life. Despite these pleas, the commission underscored the importance of following regulations and the potential implications of allowing the construction to stand.
The meeting concluded with a motion to close the hearing, with a decision pending on issuing an order of conditions. The commission will vote on the matter in the subsequent meeting, balancing regulatory responsibilities with community considerations.
