Falmouth Zoning Board Deliberates on Shorewood Drive Construction and Beach Plum Path Deck Proposal

Clower emphasized that the project would not adversely affect the neighborhood or environment and that it complied with existing zoning regulations.
Board members raised questions about specific aspects of the project, including the necessity of an IA septic system and the flood zone designation of the property. While Clower argued that the lot was not in a flood zone, documentation suggested otherwise. The Board’s deliberation included whether to impose conditions related to health department requirements and septic system compliance. Ultimately, the Board found the proposed structures to be non-detrimental to the neighborhood and suitable for the intended use, concluding with a motion to approve the project with specific conditions.
Another agenda item concerned the property on Beach Plum Path. The homeowners proposed to remove an existing deck and replace it with a larger addition and a new deck. The discussion focused on the property’s existing fencing, which encroaches on neighboring properties. One homeowner, Scott Pacling, explained the encroachment was unintentional and expressed willingness to address the issue. However, concerns were raised about setting a precedent if the board allowed the situation to persist without proper documentation.
The board debated whether the proposed changes to the deck were substantial enough to warrant a new public hearing. After reviewing the regulations, the board determined that the changes were insubstantial, thereby allowing the proposal to proceed without additional hearings. A motion to approve the proposal was unanimously supported, contingent on the homeowners providing a letter from their neighbors regarding the fencing arrangement.
In addition to these two major items, the meeting touched on administrative matters such as protocol for absent applicants and upcoming site visits for a development project on Sandwich Road. The board also discussed compliance issues related to zoning regulations and the importance of ensuring that future constructions adhere strictly to town standards.
