Fort Myers Beach LPA Approves Pathway Variances to Enhance Beach Accessibility
- Meeting Overview:
The Fort Myers Beach Local Planning Agency meeting focused on discussions around variances for beach access pathways, aiming to improve accessibility, particularly for individuals with disabilities. The LPA reviewed and approved variance requests related to beach access numbers 43 and 41, despite concerns about setting precedents for future applications. Additionally, a special exception was granted for a widened boardwalk structure. The meeting concluded with the adoption of a necessary ordinance for certified recovery residences.
Central to the meeting was the approval of variance 2025243 for beach access number 43 on Estero Boulevard. This variance allows the construction of a 5-foot-wide on-grade pathway, deviating from the 40-inch maximum traditionally allowed through a dune in an environmentally critical zoning district. The pathway, introduced by Jason Smallley from the planning and zoning department, will consist of a shell surface, replacing the previously damaged elevated walkway. The county intends to use materials like Moby Mats to facilitate access while preserving the environmental integrity of the dune.
A point of discussion was the potential encroachment of the pathway onto a neighboring property owned by Pink Shell. The property owner supported the project but sought assurances regarding their legal rights over the easement. Coordination with Pink Shell will be essential during the development order phase, where precise surveys will delineate property lines. Jordan Varble from Johnson Engineering confirmed the county’s plan to install the path, with a projected timeline of six months for completion.
The meeting also addressed LPA resolution 25-21 concerning beach access number 41 on Astera Boulevard. The agency approved a variance request to allow an 8-foot-wide dune walkover, surpassing the usual 6-foot width permitted in the environmentally critical zoning district. The request aimed to restore a structure damaged by a hurricane, with the applicant arguing for the increased width to better accommodate users, especially those with disabilities.
While some members expressed concerns about setting a precedent for wider walkways, others highlighted the benefits of raised walkways, which are less damaging to the environment than flat paths. The motion to approve variance 2025 0261 passed with a 5-1 vote, requiring a second hearing before the town council due to the non-unanimous decision.
In conjunction with the variance, the agency granted a special exception for beach access number 41. This allows for the replacement of an existing 6-foot-wide elevated boardwalk with an 8-foot-wide, 110-foot-long structure, contingent upon variance approval. The replacement aims to enhance accessibility and secure FEMA reimbursement funding for the county. The motion was unanimously approved, with conditions ensuring compliance with standard turtle season protocols.
Beyond the variances, the meeting included the adoption of proposed ordinance 25-27 concerning certified recovery residences. The ordinance aligns with state mandates, establishing a streamlined review process for accommodations related to such facilities. Although no current applications exist in Fort Myers Beach, the procedure is necessary to comply with state requirements by January 1st. The ordinance passed unanimously.
