Haddon Heights Planning Board Approves Use Variance for Home Office Amid Safety Concerns
- Meeting Overview:
The Haddon Heights Planning Board convened to deliberate on several development applications, with the most notable decision being the approval of a use variance for a detached garage with an office at 317th Avenue. The board also evaluated applications related to a front porch addition and a fence. Discussions included the importance of visibility and adherence to setback standards, particularly for properties with unique characteristics, such as corner lots.
The primary focus of the meeting was the application from Michael Fina, who sought a use variance to construct a new two-story garage, including an office, on his property at 317th Avenue. The location in the R2 residential district necessitated the variance, as the intended office use is not typically allowed within the zone. Attorney Eric Reo, representing Fina, presented the proposal to demolish the existing garage and build a 744-square-foot structure that would accommodate two cars and an office on the second floor. The office, intended for personal use, would not include plumbing and would only be equipped with electricity.
A key part of the application involved testimony from architect Nicholas Pierro, who detailed the design plans, emphasizing that the new structure would be relocated further from the street to provide off-street parking. The proposed garage would conform to zoning requirements, aside from the requested variances for height and size. Fina, addressing the board, assured that the office would serve as a private workspace to minimize interruptions at home, especially due to his children.
Public comments revealed concerns about safety, particularly regarding the new garage’s potential impact on pedestrian pathways. Resident Joseph Lero highlighted issues with cars overhanging sidewalks, a common problem in the area, posing risks for pedestrians, including children.
After careful consideration of the positive and negative criteria for the variance, the board approved the application, subject to conditions such as submitting a grading plan. The resolution will be formalized at the next meeting, with a 45-day appeal period allowing for potential contests to the decision.
In other business, the Planning Board reviewed a proposal from Sarah and Richard Thomas to construct a front porch on West High Street. The application required variances due to increased lot coverage and reduced front and side yard setbacks. To address increased impervious surface, the use of a rain barrel for stormwater management was suggested. The board approved the application, aligning with the community’s aesthetic character and planning documents.
A separate application involved Matthew Warner, who sought approval for a fence on his corner property on Sycamore Street. The proposal included a four-foot picket fence and a six-foot stockade fence, but faced challenges due to zoning ordinances prohibiting front yard fences. The board stressed the importance of adhering to a 14.5-foot setback from the curb to ensure visibility and safety, particularly given the property’s proximity to a school. Adjustments to the fence design were recommended to accommodate existing vegetation while maintaining safety standards.
The board also addressed an incomplete application from the Haddon Heights Senior Citizens Housing Corporation for a minor subdivision and site plan for a residential building. The application was deemed incomplete due to missing historic district preservation commission approval, highlighting the need for compliance with regulations to avoid automatic approval under municipal land use law.
Additionally, the liquor license subcommittee reported progress on drafting a local liquor licensing ordinance, planning a public meeting for community input before council consideration. The ordinance is anticipated to introduce two plenary retail consumption licenses, promoting community engagement and aligning with models from neighboring municipalities.
