Halifax Board of Selectmen Faces Heated Debate Over Property Classification and Zoning Issues
- Meeting Overview:
During the recent Halifax Board of Selectmen meeting, attention was given to a debate concerning property classification and zoning issues, particularly focusing on a property initially labeled as unbuildable. The discussion became heated as an audience member questioned the placement of a house on a lot, citing previous knowledge that the house was intended to be positioned at one end. This sparked a debate over the number of unbuildable lots associated with the property, with conflicting opinions on whether there were originally two such lots or just one. The matter delved into the language used by the town’s assessor’s office, which had marked the lots as unbuildable for taxation purposes two decades prior. This classification was challenged as merely relevant for tax assessments, not necessarily reflecting the lot’s development potential.
The proceedings revealed a communication breakdown regarding the property’s status, leaving parties involved waiting for clarification. The board recognized the need to address these concerns and agreed to revisit the issue in the next meeting to provide the correct answers.
Parallel to this, a detailed presentation concerning petition ZBA25-1459 for a replacement building on Paradise Lane was also deliberated. Michael Edwards from Silva Engineering Associates represented the applicant, Mr. Basigus. The proposed changes to the property included a new dwelling of 1,566 square feet with an attached garage of 322 square feet. The conservation board had previously raised concerns about the view of the lake from neighboring properties, prompting a discussion on whether to attach or detach the garage. Edwards argued for an attached garage to better preserve the view, ultimately gaining support from the board. The revised plan was approved, with the structure’s height reduced to 21 feet to comply with local standards. The board approved the updated plans, noting the septic system’s relocation to the front as a positive aspect.
In another significant agenda item, a proposal for a detached garage on Thompson Street was presented. The structure would expand from 884 square feet to 1,440 square feet, including a mezzanine. The board discussed the specifics, such as the building’s height and placement on the six-acre lot, and considered procedural aspects like the necessity for variances from zoning bylaws.
Moreover, a proposal to construct a detached garage and an accessory dwelling unit (ADU) on Oak Street was considered. The garage was approved without opposition, while the ADU, intended for the applicant’s mother, raised zoning concerns due to its nonconforming status. The applicant claimed compliance with side lot line distances and received no objections from neighbors. The board discussed the potential implications of approving such projects on nonconforming lots, reflecting on historical lot classifications and the impact of changing zoning laws.
A derelict property with electrical concerns was also briefly mentioned, highlighting ongoing community safety and compliance issues.
