Highland Beach Reduces Hefty Code Violation Fines Amid Personal Hardships
- Meeting Overview:
In its latest meeting, the Highland Beach Town Commission addressed several significant code violation cases, resulting in substantial fine reductions due to the extenuating personal circumstances of the respondents. The commission agreed to reduce fines by 50% and 90% for two separate cases, citing personal hardships such as severe health issues and contractor negligence as influencing factors.
One of the noteworthy cases involved the Diana Caner Trust, where the property was in violation for 128 days, originally incurring a fine of $32,000. The property owner, represented by an attorney, presented a case for leniency due to the owner’s mental health struggles and other personal adversities, including hospitalization and divorce. The town initially offered a 75% fine reduction, bringing the total to $8,000. However, after further discussion, the fine was reduced to $4,000, provided it is paid within 30 days.
Another case featured Michael Hazel, whose property was non-compliant for 238 days, resulting in an initial fine of $59,500. Represented by a contractor, it was revealed that Hazel, a war veteran, had been taken advantage of by a previous contractor, leaving him overwhelmed and unable to address the violations. The town agreed to a 90% fine reduction, bringing the amount to $5,950, also payable within 30 days.
