Attention then shifted to the revisions of the district’s non-discrimination policies. Attorney Matt Makavoy presented updates to policy AC, focusing on accurately reflecting all protected classes and incorporating procedures for addressing discrimination claims. A point of contention was whether to include immigration status in the policy’s initial paragraph. While some members expressed concern that omitting it could lead to discriminatory hiring practices, it was clarified that the policy aligns with Title VI of the Civil Rights Act of 1964.
Additionally, the discussion addressed the inclusion of pregnancy in the policy, proposing to retain the term “pregnancy” while removing invalidated terms. This amendment was supported after a roll call vote. The committee further decided to eliminate phrases like “pregnancy-related conditions” from the policy’s language, emphasizing the necessity to comply with federal regulations.
The meeting also delved into the district’s physical restraint policy, with new comprehensive guidelines presented to comply with updated Massachusetts regulations. Concerns were raised about the clarity of procedures related to physical restraints, particularly the absence of clinical nurses during such incidents. It was noted that regulations do not require a nurse’s presence during all restraints, although having a nurse assess the student post-restraint was deemed important. The policy outlines prohibitions against mechanical and medication restraints, with administrative procedures detailing how restraints should be implemented.
Moreover, the committee reviewed the bullying prevention policy, recommending the adoption of a recent version suggested by the Massachusetts Association of School Committees to replace the outdated existing policy. A motion to accept these changes passed without further discussion.
The agenda then transitioned to discussions about the elimination of certain policies deemed redundant. Policy ACA, addressing non-discrimination based on sex, was considered for removal due to its overlap with other policies. Similarly, the committee moved to eliminate policy ACAB, related to sexual harassment, as its provisions were already encompassed under policy AC. Both recommendations passed unanimously after roll call votes.
As the meeting concluded, the committee also approved updates to the wellness policy. This policy update, reviewed every three years, received unanimous support.
