The area will be surrounded by an eight-foot wooden fence and landscaped with six red maple trees and 13 understory trees.
Murphy addressed various safety and procedural concerns during the staff presentation. He assured the commissioners that the site plan met all necessary criteria and recommended approval with conditions. These conditions included a requirement for a letter affirming that the tower would be removed if it became abandoned. Murphy also confirmed that the site had been reviewed by the Federal Aviation Administration (FAA) and the Vero Beach Regional Airport, both of which had accepted the plan without requiring additional lighting measures.
Despite these reassurances, concerns were raised by commissioners and public commenters. A commissioner questioned the procedures for re-establishing electrical connections if the tower were to be abandoned, which would require new building permits. Another commissioner raised issues about the tower’s proximity to residential structures and an airport. Murphy clarified that the FAA regulates tower lighting and that towers under 200 feet are not required to be lit. He also confirmed that the distance from residential areas should not pose any issues.
During the public comments segment, Luke Hatman from Tower Ventures expressed gratitude for the collaborative efforts with the planning staff and requested approval of their application. However, Tom Sullivan, a member of the public, raised significant safety concerns. He questioned the common sense of placing a 100-foot tower near an airport, referencing experiences with low-flying aircraft and emphasizing the potential dangers posed by such a structure. Sullivan highlighted the frequency of aircraft over his residence and expressed concern for the safety of pilots, particularly those who may lack instrument training.
The discussion regarding the T-Mobile tower also highlighted procedural concerns about community awareness and notice procedures. A participant questioned the appropriateness of constructing a 100-foot tower in an industrial area, citing potential hazards associated with its proximity to aircraft traffic. They expressed frustration over the lack of community awareness regarding the project. The commission confirmed that proper notice procedures had been followed, including the placement of a sign at the site for a minimum of 30 days before the hearing.
The assistant Planning Development Services director clarified that administrative permits require only sign posting on the property and do not necessitate mailing notices to surrounding property owners or publishing legal ads. This explanation did little to assuage the concerns of participants who felt that more extensive notice procedures should have been employed.
Next on the agenda was a rezoning proposal for approximately 7.97 acres from Commercial General (CG) to Medical District (Meed). The Meed zoning district is designed to support major medical facilities while minimizing adverse impacts from surrounding land uses. The senior planner detailed that the proposed rezoning aligns with the commercial industrial future land use designation and does not include a future land use amendment since it is already situated within a designated commercial area.
The proposed rezoning aims to accommodate the development of multiple family housing and other permitted uses in the medical district. The site, characterized as vacant and densely vegetated, will undergo detailed environmental analysis during the specific development phase. The commission confirmed that the proposal had been evaluated by both the Vero Beach Regional Airport and the FAA, both of which had issued letters of approval.
The public hearing segment featured comments from Rebecca, representing the applicant, who expressed appreciation for staff assistance and requested approval to proceed to the Board of County Commissioners. Another participant, identified as Tom, raised concerns about the zoning changes in the surrounding area and sought clarification on the zoning status of adjacent properties.
Tom also inquired about procedural aspects related to signage and the potential for changing zoning designations. It was suggested that a petition could be presented to the County Commissioners for consideration. The commission members discussed the procedural nuances regarding height limits in the mall area, noting that any amendments would necessitate a public hearing and recommendations from the Planning and Zoning Commission before being sent to the Board of County Commissioners.
