Islamorada Planning Agency Advances Banking System for Development Rights
- Meeting Overview:
At the recent Islamorada Local Planning Agency meeting, members moved forward with a significant amendment to the comprehensive plan that introduces a banking system for Transfer of Development Rights (TDRs). This decision aims to provide property owners with greater flexibility and conservation opportunities, addressing long-standing community concerns. Additionally, Daniel Parabach was announced as the new Assistant Planning Director amidst recent staff changes.
The most pressing subject discussed was the amendment of Policy 1-3.1.3, which allows for a program to bank TDRs. This initiative enables property owners to store their development rights with the village indefinitely. The banking system is designed to resolve issues such as the inability to place TDRs due to lack of suitable land, and it provides an opportunity for conservation lands to be utilized more effectively. The ordinance was developed in response to repeated community requests and aims to facilitate transactions by allowing TDRs to be held separately from the physical property, simplifying real estate processes and potentially reducing legal complexities.
Public commentary highlighted the potential benefits of the ordinance. A speaker noted that the banking system could enhance the value of environmentally sensitive properties and aid in legal defenses against property takings claims. Another point raised was the ordinance’s ability to streamline the management of TDRs by eliminating the need for current property owners to sign off on TDR transfers when they no longer hold the development rights.
The meeting also included approval of a companion ordinance that amends village code sections to reflect the new procedures and criteria for TDR transfers. The amendments require sender sites to be cleared of invasive vegetation and maintain compliance in order to bank TDRs, with the village conducting regular checks to ensure standards are met.
In other developments, Daniel Parabach was introduced as the newly appointed Assistant Planning Director, a decision made following staff turnover. His promotion is expected to bring continuity to the department as he assumes more responsibilities, including representing the Planning Director in meetings when necessary.
