Jackson Zoning Board Approves Multiple Variances Amid Concerns Over Drainage and Setback Violations
- Meeting Overview:
In a detailed session, the Jackson Zoning Board approved various variance requests, addressing concerns ranging from drainage issues to significant setback reductions.
The most notable discussion involved Raymond Torres Jr.’s application for a variance to construct a 30 by 80 by 12-foot pole barn on Dante Court. Torres faced challenges due to wetlands and a wetland buffer on his property, requiring variances regardless of any adjustments. He proposed the barn for personal storage. The board questioned the barn’s placement and its impact on drainage, particularly on neighboring properties. Torres noted his intent to place the barn 15 feet from the property line and 35 feet from the rear boundary, aligning it with future plans to install a pool. Board members stressed the necessity of a plot plan showing wetland delineations, as these can shift over time, potentially affecting the required buffer zone. Despite suggestions to consider a smaller structure to avoid variances, Torres explained that any reduction in size would still demand variances due to the lot’s configuration.
In another notable case, Matthew and Elizabeth Flanigan sought a variance for constructing a single-car garage with an attached room on Ally Burke Road. The Flanigans emphasized their need for the addition due to the property’s irregular shape and the limitations imposed by existing zoning requirements. The board recognized the pre-existing non-conforming nature of the lot and the significant setback reductions requested. The Flanigans proposed setbacks of 15 feet and 35 feet, drastically reduced from the required 50 and 100 feet, respectively. The board expressed reservations about these reductions, yet acknowledged the constraints imposed by the adjacent wetland buffer. The Flanigans assured the board of their intention to use the new space for storage, including seasonal decorations and a nativity display. The board, considering the property’s constraints, unanimously approved the variance, with conditions ensuring the addition’s use remained consistent with residential zoning.
Mary and Anthony Gazzaniga’s application for a detached garage on Dante Court also drew attention. The proposed 45 by 45-foot structure required encroachment on the side line setback by 20 feet, leaving a 30-foot setback. The Gazzanigas argued that the garage’s location was the only viable option due to their house’s position and surrounding woods. While board members appreciated the garage’s design, which matched the home’s aesthetic, they questioned its potential future use, given Mr. Gazzaniga’s auto body business. The applicants assured the board that the garage would solely serve as personal storage for classic cars and an RV, with no plans for rental or commercial use. Concerns about access and drainage were addressed by suggesting grading improvements and the installation of gutters and a dry well. The board appeared inclined to approve the application, pending adherence to these conditions and submission of detailed architectural plans.
David Corniola’s application for a 14 by 30-foot storage shed also received board approval. Corniola’s corner lot, featuring two front yards, complicated setback compliance, prompting his request for a variance. The board noted his comprehensive understanding of land use principles and supported his proposal, provided he installed necessary drainage solutions and adjusted the location of an existing fence to comply with regulations.
