Jacksonville Beach Planning Commission Advances Ordinance Amid Concerns Over Process and Timing
- Meeting Overview:
In its December 8, 2025 meeting, the Jacksonville Beach Planning Commission addressed a ordinance concerning certified recovery residences, also known as sober living facilities, and the process for reasonable accommodation requests, amidst concerns over the rushed timeline and procedural issues.
One notable issue discussed was the proposed ordinance aimed at aligning local codes with state law to accommodate certified recovery residences in residential areas. This ordinance, driven by Senate Bill 954, necessitates that cities amend their codes to permit these facilities without prohibition. The commission’s dialogue underscored the necessity of reasonable accommodation provisions, which allow recovery facilities to operate within residential zones under state and federal guidelines.
A participant in the meeting sought clarity on the parameters for reasonable accommodation requests, questioning why such requests were necessary when state law already permits these facilities. It was explained that the city manager holds the authority to determine if a request will be considered, with the provision serving as a mechanism to address unforeseen issues not covered by existing zoning laws. An example presented was the potential location of a recovery facility in an area with septic tank challenges.
The commission voiced apprehension over the ordinance’s timeline, with a scheduled vote by the city council on December 15, just days after the meeting. Concerns were raised about the limited time for review and recommendation, with one member expressing that the timeline was “a little tight.” The absence of legal representation during the meeting further fueled frustrations, as it impeded thorough discussion on potential recommendations. The city attorney’s attendance at a council briefing was noted, with another staff member present to fill in.
Another focal point was the inclusion of an appeal process in Section F of the proposed ordinance. The commission was concerned that this process bypassed their authority, directing appeals directly to a special magistrate. Members agreed that this aspect warranted further scrutiny before a vote, with suggestions to amend the ordinance by removing design responsibilities from the planning commission and assigning them solely to the city manager. A request for a comprehensive briefing from the city attorney was proposed for early 2026, allowing for more discussion and potential amendments.
The commission grappled with articulating a motion to recommend the ordinance’s approval, contingent on specific amendments, particularly regarding the appeal process and the city manager’s responsibilities.
In addition to the ordinance, the commission unanimously approved a conditional use request for an accessory dwelling unit (ADU) on South 3rd Avenue. The property, located in a residential multifamily zoning district, met all zoning regulations and development standards. Applicant Jeremy Laferty plans for the ADU, emphasizing compliance with city utilities and parking requirements. No public opposition was recorded, leading to the approval of the application.
Finally, the meeting concluded with the planning department’s report that no further meetings were scheduled for the year. A moment of recognition was dedicated to Morgan Moring, honoring her ten years of service on the planning commission. The meeting adjourned following a motion and second.
