Another aspect of the meeting involved the review and recommendation of proposed amendments to Chapter 105, which pertains to building demolition, and Chapter 345, which deals with Land Development ordinance. These amendments were instigated by an appellate court ruling, necessitating changes to make the demolition ordinance more enforceable. The commission proposed shifting Historic Preservation Commission requirements from Chapter 105 to Chapter 345, thus empowering the zoning officer to enforce these provisions. Key amendments included clarifying the demolition permit application process, establishing a 45-day review period, and ensuring that prior approval for demolition remains valid for one year from the date of issuance. The commission debated the 45-day timeline, with concerns raised over the potential legal implications should the timeline not be met and the need for internal deadlines to administer the ordinance effectively. Adjustments were also made to language in various chapters, including the removal of references to phase one and phase two surveys and emphasizing the building’s inclusion in the master plan.
The commission addressed an application for a certificate of appropriateness for the restoration and alteration of a fire-damaged Italianate townhouse on Montgomery Street. The proposal included a full-height rear yard addition, front facade restoration, and interior renovation. The applicant’s representative, Stephen Joseph Esquire, provided details on the fire damage and the need for new construction. The commission engaged in discussions about the proposed balcony, roof deck, and the reconfiguration of the side elevation. The commission also requested detailed structural drawings, reviewed photographs of the rear facade, and sought clarification on materials and colors to be used. The applicant assured the commission that the structural drawings were intended to stabilize the front facade during construction. Staff recommended approving the Certificate of Appropriateness with conditions to preserve the clapboard on the western side of the building, minimize the bulkhead height, and change the balcony door to a swing door with a window. After the commission’s deliberation, the COA was approved with conditions unanimously.
