Lakeville Conservation Commission Approves Tree Removal, Eyes Stronger Environmental Guidelines
- Meeting Overview:
The Lakeville Conservation Commission convened on June 9th to address several pressing environmental issues, including the approval of a tree removal request at Nine Hilltop Acres Drive and the Clark Shores Association’s drainage work without proper filings.
The most notable topic of the meeting was a request to remove a tree at Nine Hilltop Acres Drive, presented by Mark, who had previously conducted a site visit. The tree’s roots were dangerously close to a cement bulkhead, posing a risk to the structure. This prompted a proposal for its removal using a crane, as the site’s access was limited. The Commission debated whether the property owner should file a Request for Determination of Applicability (RDA) for the removal, as practices had varied in the past depending on proximity to water and removal methods. Mark emphasized the importance of consistency and suggested streamlining future similar requests. The Commission agreed on the necessity of establishing clear guidelines for tree removal to prevent unauthorized actions by property owners.
Dan Desari, the property owner’s representative, explained that the terrain necessitated the use of a crane for the tree’s removal to prevent it from falling into the water. This led to a formal vote, with the Commission unanimously approving the removal request. Members stressed the importance of documenting the decision to provide clarity in case of future inquiries and agreed to place the task of formulating guidelines for tree removal on the agenda for future discussions.
The Commission also tackled the issue of drainage work carried out by the Clark Shores Association without a formal filing. The public hearing revealed that trenching and installation of underground drainage pipes had been completed across properties at 15, 16, and Shore Avenue without proper compliance with regulations. This raised concerns about adherence to the Wetlands Protection Act. The Commission decided to issue a positive determination, necessitating the filing of a Notice of Intent for the work conducted. Property owners were notified of the violations and given a deadline to comply with filing requirements by July 9th, to be discussed in a subsequent meeting on July 14th.
Throughout the discussions, the Commission expressed the need for thorough planning and professional engineering oversight to ensure compliance with environmental standards. They emphasized that the property owners should consult with engineers to meet the Wetlands Protection Act’s requirements.
In addition, the Commission addressed concerns from residents about access to a local waterway, particularly a pathway cleared to the lake. A resident from Hickory Lane highlighted efforts to create a pathway, noting that previous overstepping by a neighbor had raised concerns about property lines and the extent of clearing permitted. The Commission referenced local regulations, allowing a maximum path width of 30 inches, and stressed that maintaining pathways without significant alterations would be exempt from their jurisdiction. The Commission planned to draft a letter outlining the parameters and rights related to the path to ensure compliance and prevent further disputes.
Finally, the Commission touched on old business concerning a site visit on Cleopon Road. A site visit revealed issues with the septic system, particularly an exposed pipe that risked freezing. While not within their purview to alter health board approvals, the Commission suggested insulating or burying the pipe deeper to prevent freezing. The meeting concluded with plans for further site visits to ensure ongoing engagement with the project.
