Lakeville Residents Voice Concerns Over Proposed Development on Beachwood Avenue
- Meeting Overview:
The Lakeville Zoning Board of Appeals convened on July 16th to deliberate on a proposal by Olive Air Investment Incorporated seeking a special permit and variance for a residential development on Beachwood Avenue. The application, representing a shift from a vacant summer cabin to a potential full-time residence, sparked extensive discussion and concern from both the board and nearby residents regarding issues of zoning compliance, environmental impact, and neighborhood character.
At the heart of the meeting was the proposal to build a small single-family home on the approximately 16,000-square-foot lot, previously occupied by a cabin that had been demolished. The applicant’s attorney, Nicholas Gomes, presented the project as a 1,000-square-foot home, noting it would either be one or two bedrooms, depending on septic system limitations. Gomes argued that the project would align with the neighborhood’s residential character and enhance the town’s tax base.
However, the proposal was met with resistance from local residents, notably Patrick. Sullivan requested the board deny the application or impose conditions if approved. His concerns centered on drainage issues allegedly caused by the applicant’s previous developments, which necessitated the installation of a French drain on Sullivan’s property. Sullivan also cited potential exacerbation of groundwater nitrate contamination and urged the board to mandate independent engineering reviews and mitigation measures.
The board members engaged in a conversation about the potential environmental impacts of the development. The Board of Health had already raised concerns over the proposed septic system, given the area’s existing nitrate level issues. Gomes acknowledged these concerns. He also expressed readiness to collaborate with the Board of Health to address these issues.
Stormwater management emerged as another critical point of discussion. Board members highlighted the importance of ensuring the new construction would not worsen runoff issues, with one member noting, “It’s a thousand square foot roof; it’s going to be adding water and runoff.” The board appeared inclined to conditionally approve the project, contingent on the submission and approval of an engineered stormwater management plan.
The applicant’s attorney suggested that such environmental challenges were typical in development projects and could be mitigated through standard procedures. He assured the board and residents that a full survey would be part of the process, with plans developed based on benchmarks and public records. The attorney stressed the potential for the project to improve current site conditions.
Despite the concerns voiced, the board eventually leaned towards conditionally approving the development, requiring a comprehensive stormwater management plan before final permit issuance. Construction hours were also to be restricted, with no start before 8 a.m.
Following the extensive discussion on the Beachwood Avenue proposal, the board swiftly addressed a less contentious matter: a request from James Caceri to replace an existing shed on Beachwood Avenue with a larger one. The board quickly approved this request, viewing it as a routine decision.
The meeting concluded with administrative tasks, including the approval of previous meeting minutes and a reminder of the next scheduled meeting on August 20th, where discussions on the Simmons Hill project were anticipated. The session adjourned with unanimous consent.
