Landlord-Tenant Tensions Highlight Oviedo Special Magistrate Meeting on Code Violations
- Meeting Overview:
The recent Oviedo Special Magistrate meeting addressed several code violations, with focus on landlord-tenant disputes and property management issues. Key discussions included non-compliance with city codes concerning window safety at a rental property and unresolved outdoor seating permits at an apartment complex, alongside notable cases involving parking violations and open storage issues.
The most prominent discussion revolved around a property on Horseman Drive, where a tenant presented grievances against the landlord, alleging retaliation and inadequate maintenance. The tenant claimed that the landlord refused rent payments and instead billed for repairs allegedly unrelated to the tenant’s actions. The tenant detailed attempts to pay rent via cashier’s check, which was reportedly refused by the property manager, leading to a pay or quit notice. They also provided evidence through photographs and Google Street View images, illustrating pre-existing damage to the property.
In addressing the code violation concerning window safety, the city inspector confirmed that numerous windows lacked functional locks, posing security risks. Despite the property management’s claim of addressing these issues, reinspection revealed persistent problems. As a result, the magistrate ordered the property management to install functional locks and ensure the windows were weatherproof by November 20, 2025. Non-compliance would result in daily fines of $150.
The magistrate clarified their inability to mediate the rent dispute, advising the tenant to seek legal assistance if necessary. The focus remained on ensuring code compliance, with the magistrate emphasizing the importance of resolving the window safety issue promptly to address the tenant’s security concerns.
Another case involved Parkplace Apartments of Ovito LLC, where the city pursued compliance regarding outdoor seating installed without necessary permits. The property, now under the management of Strand Apartments LLC, had been in violation since May 14, 2025. Despite extensions and attempts to engage the property owners, no application for permits was submitted. The magistrate set a compliance deadline of November 13, 2025, after which fines of $100 per day would begin if the outdoor seating was not removed or permitted.
The meeting also reviewed a longstanding issue of parking violations on Coington Street, where large vehicles such as RVs and trailers repeatedly violated local ordinances by being parked inappropriately. The property owners, identified as Mary Adams and Sher Wingler, faced a compliance deadline of November 20, 2025, with potential fines of $100 per day for further non-compliance. The magistrate expressed concerns about the owners’ pattern of temporary compliance followed by repeated violations, warning that future infractions could lead to increased penalties.
Lastly, the magistrate discussed a case concerning open storage violations at a property on Geneva Drive. The owner, Bruce E. Willton, had previously been cited for tree debris storage. In light of these efforts, the magistrate decided against imposing fines, acknowledging the owner’s attempts to comply and the challenges faced in removing the debris.
