Livingston Zoning Board Grapples with Oversized Home Proposals and Community Concerns
- Meeting Overview:
The Livingston Town Zoning Board meeting on October 28, 2025, focused on several applications, the most notable being for new home constructions and substantial modifications to existing homes.
A key application that drew discussion involved the proposal by Elaine and Scott Hamman to construct a new single-family home and garage on Hazelwood Avenue. The existing structures, described as deteriorating and not well-maintained, were set for demolition to make way for a new house intended to accommodate the family’s needs, including their elderly parents. The lot in question presented significant challenges due to its undersized nature, featuring only 50 feet of width against the 75 feet required and a total area of 6,577 square feet compared to the 9,375 square feet zoning requirement.
The proposed new home raised concerns because of its habitable floor area of 3,440 square feet, above the 3,220 square feet maximum permitted. This discrepancy was a focal point during discussions, with board members questioning the rationale behind seeking multiple variances, including those related to front and side yard setbacks. The project featured a three-bedroom layout on the second floor and a habitable attic, designed to maximize space without utilizing the basement, which had structural limitations.
Board members scrutinized the proposed setbacks and the positioning of the detached garage, particularly its proximity to neighboring properties, which was noted to be just 2.5 feet from the rear property line, half of the required distance. Concerns were raised about the potential impact on the surrounding neighborhood’s character and the practicality of such close proximity to neighbors’ properties.
The board’s discourse emphasized the challenges of fitting modern amenities into an undersized lot while adhering to zoning guidelines. Members expressed reservations about the overall size of the proposed home. Despite the applicant’s efforts to align the new construction with the neighborhood’s aesthetic, the extent of the variances sought sparked debate on its suitability.
During the meeting, it was suggested that the applicant consider revising the plans based on the feedback received. The possibility of a continuance was introduced, allowing for adjustments to the design or confirmation of the current proposal. The board agreed to adjourn the matter until the next available meeting, providing the applicant time to reassess and potentially modify the plans.
Another notable application involved Rodak Homes, Inc., which sought approval for a new construction project on Elwood Drive. This proposal included demolishing an existing single-family home and building a new two-story house. The design featured a colonial-style architecture with a habitable floor area of 3,132 square feet, slightly above the zoning ordinance’s requirements. The application required variances due to front and side yard setbacks not meeting current standards.
Professional planner Nicholas Graviano provided testimony, emphasizing that while the proposed design exceeded the allowable habitable floor area ratio, it rectified existing nonconformities and would enhance the visual environment. One board member highlighted concerns about potential traffic disruptions during construction, particularly during school pickup times, stressing the need for the applicant to manage debris and install safety measures. Despite these concerns, the board found the proposal suitable, ultimately approving the application.
A third discussion revolved around Joseph and Katherine Ferry’s request for a two-story addition to their home on Twin Oak Road. The Ferrys, long-term residents of Livingston, sought to expand their home to accommodate their growing family. Their application required a D variance for the addition, which included a family room and kitchen on the first floor and a master suite above.
