Santana emphasized the ongoing nature of their agricultural operations, which he deemed compliant with state laws protecting farm activities. He further requested the magistrate to consider dismissing the case, arguing that the town’s citations were preempted by state law, specifically Florida’s green belt law and the Florida Right to Farm Act.
The magistrate clarified that any appeal against the initial violation ruling needed to be filed in circuit court, as the current hearing was solely to assess fines for ongoing violations. The magistrate upheld the previous ruling, confirming continued violations beyond the compliance deadline of July 2, 2025, and imposed a fine totaling $500, calculated at $100 per day from July 3 to July 7, with ongoing accrual until compliance was achieved.
Similarly, the case of Jose and Raymon Valia, concerning the property on A Road, addressed violations related to unauthorized business operations and storage. Despite an agreement with the town to remove a pay transfer business and associated trucks, violations persisted. Initially, the town sought compliance within 90 days, subject to daily fines of $150 per violation and administrative costs of $23,405. However, the magistrate decided to renotice the case owing to the timing of the original notice.
In a separate matter, American Print Tax Investment, Inc. was cited for violations regarding RV registration and maintenance. The lack of response from the respondent led to fines and administrative costs being reaffirmed, with the magistrate determining that violations remained unresolved.
