The absence of the property owner at the hearing led to a finding of good service based on the posted notice and the compliance officer’s testimony. The magistrate ordered compliance by the specified date or an appearance at a subsequent fine assessment hearing.

The son of the property owner communicated that his mother was hospitalized, and he was working toward compliance. This case highlighted the personal challenges some property owners face in meeting ordinance requirements. Nonetheless, the town maintained its stance on compliance by the April deadline, with consistent penalties for non-compliance.
