The city sought a fine of $150 per day for the non-compliance, with a 30-day period set for the property to comply. The Magistrate ruled in favor of the violation and provided the property owner with 30 days to rectify the issue.
Another case addressed during the meeting involved a property on North Bayshore Drive, owned by Cara McKenny. The property was cited for the replacement of a deck without the requisite permits, detected through proactive code enforcement. Mills issued a courtesy notice followed by a formal notice of violation after the property failed to comply. McKenny communicated with the city, explaining that she believed the general contractor she hired was responsible for obtaining the necessary permits. The Magistrate inquired about the exact nature of the deck replacement and whether it was in the same location, to which McKenny confirmed. The city requested the contract between McKenny and her contractor to advance the permit process, and McKenny complied, apologizing for the oversight. The city recommended a 10-day window for compliance before imposing a daily fine of $100. The Magistrate found the property in violation and set a 10-day deadline for compliance.
The meeting also touched on a third violation involving interior remodeling and drywall replacement without a permit at a multi-family property. The violation was initially observed in November, with a courtesy notice issued and a corrective action deadline set for early December. This case also resulted in a stop-work order, which was documented in a photograph presented at the hearing. The property owner was given 10 days to comply, with a $100 per day fine to be levied if the deadline was not met. The Magistrate confirmed these terms.
