- Meeting Overview:
At the latest Margate Planning Board meeting, property developments were approved, including the conversion of a preschool into residential units and the construction of new homes with required variances. The board granted the variances after thorough discussions, recognizing the unique circumstances of each case and the minimal impact on the surrounding neighborhoods.
One focus of the meeting was the future of a property on North Decatur Avenue, which currently houses a preschool. The owner, citing a 40% decrease in the preschool’s student body and the financial burden of maintaining the oversized property, proposed converting it into three residential units, reducing the original plan from four units to three. The project, which includes two two-bedroom units and one five-bedroom unit, sought variances for conditional use, front yard setback, and density. The board engaged in a review of the project, taking into account the history of the property, the challenges of the current use, and the support from neighboring residents. The owner’s argument against the commercial space requirement on the ground floor was given due consideration, especially in light of the area’s inadequate foot traffic for commercial businesses and the property’s provision of more than the required parking spaces. After evaluating the proposed units, parking, and impact on the neighborhood, the board approved the preliminary and final major site plan, along with the necessary variances, deeming the residential development as an improvement to the neighborhood.
The board also discussed an application for Robert and Lisa Miller’s property, which required variance relief for the expansion of the master bedroom and coverage of a second-floor deck. The architect presented plans to modernize the house, including an increase in building coverage and roof pitch variance. Board members examined the square footage increase and its neighborhood impact. The application was unanimously approved, with the board supporting the improvements.
Another case involved Michael and Mandy Dorfman, who sought variance relief for constructing a new single-family home on a lot with unique size constraints due to recent changes in the city’s zoning code. The debate centered on whether the construction met the C1 or C2 criteria for variance approval. No final decision was reached, but the discussion underscored the intricacies of zoning regulations and their implications for property development.
The legal aspects of granting variances were also a topic of interest. It was emphasized that decisions would not establish precedents, as each case must be considered on its own factual circumstances. The speaker referred to New Jersey municipal land use law and a state Supreme Court case to support this stance, noting that the applicants did not create the hardship of the undersized lots, which had been established by the city in 2007.
In another application, the board granted a 9-0 vote in favor of a variance for a construction project supported by the neighbors and meeting the land use law requirements. This case involved a second-floor addition to an existing single-family home, where the representative argued that the improvement would maintain light and open space without substantial detriment.
The meeting also saw discussions of a proposed construction project including a third-floor deck, the elevation of the house, and the enclosed first floor. Despite some concerns, the public voiced support, and the homeowners agreed to remove the third-floor rear deck from the plan, which helped alleviate some board members’ reluctance to grant the variances.
Further deliberations involved traffic safety concerns around the preschool, the lack of foot traffic for potential commercial businesses, and the impact of nearby developments on the aesthetic appeal of the neighborhood. The proposed building project, which sought deviations for density and ground-floor commercial space, was described as consistent with the neighborhood’s size and density.
