Among these, the case involving repeat offenders Shan T. Cassidy and Mark L. Cassidy III stood out due to the previous stipulation agreement and the imposition of a new fine. The council was faced with evidence of recurring violations at the Cassidy property on Southeast Dominica Terrace, leading to a fine of $100 per day for each violation and additional costs of $575 for the investigation.
The Cassidy case drew attention as it represented a challenge to the effectiveness of enforcement measures and compliance by property owners. Officer Chris Councel presented detailed evidence including photographs of the property’s condition, which showed recurring issues with nuisance, trash, debris, abandoned vehicles, and violations of industrial district land development regulations. While the Cassidys demonstrated some efforts to comply by fencing off areas and covering stored items, the hearing officer found these measures insufficient, resulting in the imposition of fines.
Another compelling matter was the fine reduction hearing for Thomas Glass, involving a property on Northwest Sunset Boulevard. Glass’s infractions dated back to 2011 and included various issues such as nuisance, trash, glazing, and protective treatment violations. Despite presenting his hardships and efforts to rectify the problems, the magistrate approved the stipulation and agreed to the recommended order without considering Glass’s personal circumstances further.
The council also addressed the case of Martha Lara, who faced a violation for an unpermitted fence replacement and installation of an air conditioning unit at her property on Southeast Janet Street. Despite multiple notifications and opportunities for compliance, Lara was found in violation. The council issued an order for compliance by a certain date, with daily fines and reimbursement of investigation costs as potential consequences for non-compliance.
Similarly, Casey Levy faced issues with an unpermitted addition to a mobile home on Southeast Eagle Avenue. Levy was given a deadline for compliance.
The meeting proceeded to discuss other violations, including one involving Scorpio Summer Season LLC, which admitted to high grass, trash, and debris on their property. The council set a compliance deadline and potential fines. Jerry L Owens Jr.’s case, involving a damaged fence, was also deliberated, with the council finding a violation in the absentee owner’s case and setting a compliance timeline with accompanying fines.
Alfred Dagostino’s property drew attention due to the accumulation of trash and inoperable vehicles. While there was some confusion regarding the request for costs, the council still moved forward with a compliance order and outlined the possibility of fines.
Unique cases, such as Cara Azen’s swimming pool violation, also surfaced. The council found it appropriate for the county to abate the nuisance and hold Azen responsible for costs. Additionally, the Hob Sound Mobile Home Park Inc. faced a violation for an expired permit application for enclosing a screen porch, and Christian and Michael Midok were found in violation for an unpermitted bamboo fence divider and patio pavers. In both instances, the hearing officer approved the stipulated agreements and orders.
