Martin County Magistrate Reduces Fines for Code Violations Amidst Ongoing Compliance Issues

This case involved an outstanding violation order from 2021. The respondents proposed a settlement of $17,450, which was accepted by the magistrate as compliant with county regulations, with the payment due within 30 days.
Another discussion revolved around compliance challenges faced by Melba and George Nelson for their property on Southeast Carol Street. An initial violation recorded in 2023 had accumulated fines amounting to $82,200. The Nelsons offered to settle for $4,000, a proposal accepted by the magistrate given the property’s assessed value of $40,000.
The council also addressed a compliance extension request from the Francis H. Puri Revocable Trust concerning a roofing issue on Southeast Burning Tree Circle. Due to difficulties in engaging a roofing contractor, the magistrate extended the compliance deadline from February 18, 2026, to July 31, 2026.
Beyond these individual cases, the meeting highlighted widespread issues of code non-compliance throughout Martin County, with several properties facing similar violations. One notable example was the estate of Fanny M. Moore, where the property on Southeast Wesley Avenue exhibited high levels of trash, debris, and inoperable vehicles. Despite multiple notices, compliance was not achieved, leading to the imposition of fines and a demand for reimbursement of investigation costs.
Similarly, the council reviewed the case against Roco Lamatrice for the property on Southeast Boxwood Lane. Despite repeated notices and inspections, violations persisted, resulting in a compliance deadline of June 30, 2026, with an associated daily fine for non-compliance.
In another instance, Michelle and Paul Brooks, owners of a property on Southeast 48th Avenue, entered into a stipulation agreement to resolve their violations. Despite their absence at the meeting, the Brooks agreed to pay $350 and committed to compliance by August 31, 2026, subject to daily fines for any ongoing violations.
A recurring theme was the absence of property owners at the hearings, leading to continued non-compliance and financial liabilities for those involved.
