In contrast, the board approved a variance request for a swimming pool installation at a single-family home on Lake Valerie, owned by Candace Spears. The pool proposal involved an 8-foot and 1-inch encroachment beyond the property’s TI line. Despite the absence of letters of support from neighbors, the planning staff recommended approval, arguing that the development was compatible with the neighborhood’s character.
The pool proposal was characterized by unique circumstances, including the home’s construction in the 1980s, which resulted in its unusual proximity to the TI line. Staff noted that the variance would still leave a significant 38 feet of unencumbered slope area, reducing potential impacts on the surrounding environment. Board members were familiar with the area and recognized the challenges posed by older homes that predated current zoning regulations.
The board deliberated on the pool’s placement, with some members suggesting moving it further east to reduce encroachment. However, the consensus was that the current positioning was suitable, given the property’s unique layout. After discussion, the board approved the variance, acknowledging the reasonableness of the request and the minimized pool size compared to standard proposals.
