Miami Lakes Town Council Approves Variance for Home Addition Amid Zoning Debate
- Meeting Overview:
In a recent meeting, the Miami Lakes Town Council approved a contentious variance request that allows a homeowner to construct an addition infringing on the town’s zoning setback requirements. The decision came after extensive discussion about zoning regulations, property modifications, and compliance with community standards, highlighting the ongoing challenge of balancing individual needs with municipal codes.
The council’s most significant decision revolved around a variance request from Natalie Santos, who sought approval to build a 30×50-foot addition to her home on Miami Lakeway South. The addition was necessary to accommodate her husband, who suffers from ALS and requires wheelchair accessibility, as well as her extended family. However, the proposed design would encroach 15 feet into the required 25-foot rear property line setback. Despite initial recommendations from town staff to deny the request due to zoning violations, including a past issue with fence placement, Santos’s appeal to the council was grounded in the practical needs of her family.
Santos explained that her home was too small to meet her husband’s mobility needs and that she required additional space for her parents to assist with his care. She highlighted the unique layout of her property, which limited expansion options without violating setback rules. This plea resonated with some council members, although others raised concerns about the lack of prior modifications made to the house, such as widening doors or altering bathrooms, which might have reduced the need for such a substantial addition.
Debate ensued over the necessity and scale of the proposed addition, with some council members expressing skepticism about the size. One member remarked that the addition would nearly double the size of the existing home, raising concerns about its compatibility with the neighborhood’s aesthetic and zoning standards. A compromise was reached. Santos showed willingness to adjust her plans and collaborate with her architect to create a compliant design.
Ultimately, the council approved a motion to allow a 20-foot setback for the addition rather than the standard 25-foot requirement, with several members highlighting the importance of addressing Santos’s specific needs while maintaining community standards.
In addition to the Santos variance, the council addressed a similar request from Diego Machin for his property on Point Sienna Court. Machin sought variances to increase impervious area in his front yard and extend pool decking beyond typical limits. Staff recommended against some of these requests due to zoning concerns. The council debated the impact of increased impervious surfaces on stormwater management, emphasizing the need for effective drainage systems to mitigate potential issues.
The council also deliberated on the regulation of commercial vehicles in residential areas. A proposed ordinance sought to clarify the definition of commercial vehicles and prohibit their overnight parking in residential zones. This move was prompted by ongoing issues with visible commercial vehicles, particularly those displaying business logos. The council emphasized the need for aesthetically acceptable coverings for such vehicles and acknowledged the challenge of enforcing these regulations, especially during night hours.
Further discussions explored the possibility of allowing online sales showrooms in specific low-density office districts. The proposed ordinance would permit limited viewings by appointment only, addressing concerns about increased foot traffic and parking issues in residential office districts. The council voted to approve the ordinance.
