During a recent Newbury Conservation Commission meeting, matters regarding environmental compliance, restoration efforts, and the ratification of emergency certificates were at the forefront of discussions. The meeting, which included a variety of agenda items, largely focused on the issuance of compliance certificates for several properties, the review of unpermitted work, and the need for emergency restoration of public pathways and removal of hazards from the beach.
One issue addressed was the town of Newbury’s request for an emergency certificate for the restoration of existing pathways and the removal of medical waste from the beach. The urgency of this work was discussed in relation to public safety and emergency access. The commission ratified the emergency certificate following a discussion that probed into the emergency nature of the work and the materials used for restoration.
Additionally, the commission considered a certificate of compliance for the Basin Front Drive property. The homeowner aimed to close out the surrounding land by replacing a patio with grass and installing a stone walkway. After an in-depth review and discussion, the commission issued a certificate of compliance for the property.
Another topic was the Oldtown Hill reservation, where a wildlife viewing platform had been completed. The project manager for the trustees presented the project, which received positive feedback from the commission, culminating in a unanimous vote to issue a certificate of compliance, with one member abstaining.
A request for a certificate of compliance from 14 Island Boulevard Sunset Club was also put forth. Represented by Millenniengineering, the site was reported to be in substantial compliance with the original plan, albeit with minor deviations. The property owner had obtained approvals from various local boards for these changes. The commission voiced the need for a new notice of intent to address the after-the-fact work and debated the appropriate steps to ensure compliance with flood zone and building code requirements. The group agreed that a site visit was essential to proceed but was divided on its timing relative to the filing of a new notice of intent.
The installation of a dual-wall tank and the impacts of a former fuel station were also discussed, along with the need for a separate access for clean out and pumping of a grease trap. The commission expressed intentions to issue an enforcement order to bring the site into compliance with the old permit and to address the absence of plants along a fence line. It was decided that a site visit would be scheduled to gain clarity on the proposed changes and to inform the commission’s decision-making process.
Enforcement orders for unpermitted work were also a topic of discussion. The commission gave the property owners on Northern Boulevard 60 days to submit a restoration and planting plan, with a review set for a later date. Additionally, the commission assessed the buffer zone mitigation plan for the Newbury Golf Center and discussed the steps needed for obtaining a certificate of compliance.
Requests for determination of applicability were presented for a property on Jackson Way and Melody Lane. The homeowners outlined plans for maintaining garden areas and installing a generator, respectively. The commission issued negative findings for both requests. Furthermore, discussions about other generator installations on Columbia Way and Harvard Way culminated in recommendations for elevation requirements to ensure compliance with floodplain management.
Lastly, the commission deliberated on a project on Street, where a single-family dwelling was being constructed on a pile-supported foundation. An updated planting plan was reviewed, and after questions regarding the types of plants being replaced, the commission issued an order of conditions for the project.
The meeting also covered administrative matters, such as budget discussions and collaborations with US Fish and Wildlife and Mass fishing wildlife on endangered species. Educational outreach methods and the installation of new signs on access ways were also mentioned.
