North Miami Magistrate Faces Financial Hardship, Code Violations, and Compliance Challenges
- Meeting Overview:
The North Miami Special Magistrate meeting addressed numerous code enforcement cases, with attention on property owner John Ferris Jelkey IV’s financial struggles and multiple code violations, including liens imposed by the Colorado Department of Justice.
Central to the discussions was the case of John Ferris Jelkey IV, who detailed his financial predicament attributed to liens connected to a deceased partner. These liens have led to severe financial hardship, impacting his ability to pay property taxes and risking foreclosure. Jelkey, a longtime resident of North Miami, expressed his willingness to either demolish or renovate a deteriorating property he owns on North Bay Drive. However, he noted that the existing liens made obtaining a loan for renovation or demolition impossible. Jelkey requested a 60-day extension to secure a $2.2 million loan, crucial for addressing the property’s compliance issues. While building department officer Shaunie Pressy acknowledged the need to secure the property, she did not recommend abating the liens, emphasizing the importance of compliance without removing the financial encumbrances.
The magistrate granted Jelkey the requested extension, stressing the necessity of securing the property and complying with city regulations. Jelkey assured the magistrate of his plans to install a containment fence to address safety concerns and committed to reporting progress to the officer. Jelkey’s assistant, Peter Wolfman, reiterated their dedication to meeting city requirements, listing actions already undertaken, including draining a multi-level pool and having a contractor ready to obtain necessary permits. The magistrate clarified that failure to comply within the 60-day period would result in a daily fine of $500.
Beyond Jelkey’s situation, the meeting addressed other significant cases involving property violations and compliance challenges. One such case involved Sadma Investments and Development LLC, facing unresolved issues related to a business tax receipt (BTR) for All Day Everyday, Inc. Despite efforts to rectify the situation, including updating the grease trap and applying for permits, the magistrate noted the prolonged duration of the case, which had been open for nearly three years. An extension of 60 days was granted to allow Sadma Investments to complete necessary applications and inspections.
Another noteworthy case involved Jamie L. Noble, representing her late father, Jimmy Noble, in a violation concerning a black iron fence built without a permit. The magistrate acknowledged the complications arising from pending property ownership updates following probate proceedings and granted a 60-day reset to facilitate the necessary updates in county records.
The meeting continued with discussions on other code violations, including those involving Keystone Residential Development LLC. The company faced multiple cases related to unpermitted work following a vehicular crash and failing to obtain a reoccupancy transfer of title. Each case received a 30-day extension to comply with city regulations, with daily fines imposed for continued non-compliance.
