North Miami Special Magistrate Examines Widespread Non-Compliance Among Property Owners
- Meeting Overview:
The North Miami Special Magistrate convened to address several code violations, notably involving issues with business tax receipts, permits, and structural compliance across various properties. The session underscored the ongoing challenges faced by property owners in adhering to city regulations, with many failing to appear or provide necessary documentation, resulting in fines and extensions.
A significant portion of the meeting concentrated on the Green Witch Association, which has been grappling with compliance issues since 2023. The association representatives detailed their struggles with management changes and the costly 40-year re-certification process. Originally estimated at $300,000, the costs have ballooned to nearly $2.4 million due to ongoing construction and required city approvals. The association has secured a $3.5 million line of credit to address these issues, with the structural portion of the re-certification now complete. However, complications persist with the electrical recertification due to outstanding deficiencies. The city requires individual permits from each of the 221 owners, a challenging task given the number of absentee owners. The association’s proposal to hire a single contractor for repairs was denied, as the city demands unanimous owner consent, further complicating the resolution process.
Another noteworthy case involved the property at 14695 Northeast 18th Avenue, which has been cited for exposed cracks and rebar issues. Despite an open permit for repairs, no progress was visible during a reinspection conducted in October 2023. The property owners claimed ongoing efforts with the inspector, proposing a walkthrough to establish a repair timeline. The magistrate agreed to allow an additional 60 days for progress, emphasizing the need for a clear plan to address the violations.
The North Miami Special Magistrate also addressed the case of Triina E. Lois, who has suffered from unresolved water leakage issues in her apartment due to maintenance neglect in the unit above hers. Despite prior attempts to contact the owner of the upper unit, complications arose following the owner’s passing. Miss Lois has been unable to fix her bathroom for six years, with the magistrate imposing a daily fine of $500, retroactive to July 2024, and advising Lois to seek civil action for resolution.
The session saw numerous cases of non-compliance, such as 13900 Investment Inc., which failed to obtain a business tax receipt and certificate of use, resulting in a $250 daily fine for each violation. Similarly, Crow Investment LLC faced fines for unpermitted fence installation, and Hans Jean Baptiste incurred penalties for failing to obtain necessary permits for a restaurant and lounge property.
