Norton Conservation Commission Tackles Violations and Reviews Mixed-Use Developments
- Meeting Overview:
The Norton Conservation Commission convened to address pressing violations on King Phillip Road and West Main Street, as well as to deliberate on multiple development projects in town. The meeting was a hybrid format with some members present in town hall and others participating via Zoom. The commission prioritized discussions on environmental compliance and the impact of new developments on local ecosystems.
One focus of the meeting was the ongoing violation on King Phillip Road, where restoration efforts are already underway. Professional engineer Michael Cahill provided an update on the progress, highlighting coordination with a wetlands consultant and surveyor. The team developed a restoration plan to meet the commission’s standards, which included replanting species, drafting a construction plan, and ensuring compliance with permits. The commission deliberated on the timeline for submitting a Notice of Intent (NOI) for the project, debating whether to expedite the process to avoid issues with seasonal stabilization. Concerns were raised about the necessity of erosion prevention measures, given the approaching winter.
The commission also examined the violation on West Main Street, where a patio was constructed without a permit within a riverfront area. John Thomas, Conservation Director, confirmed the unauthorized construction following a site visit and photographic evidence. The property owners, represented by attorney John Kelky, were unaware of the need for a conservation permit. The commission stressed the importance of assessing the environmental impact and ensuring legal compliance. There were concerns about the stability of the site, with particular attention to the vegetative ground cover and the location of dumpsters in wet areas. The commission is awaiting the submission of necessary documentation by the September 22 meeting to address these issues.
In addition to handling violations, the commission considered the development of a mixed-use site on West Main Street, home to Honeydew Donuts. The proposal includes relocating existing establishments and adding residential and commercial spaces. A representative from Strong Point Engineering outlined plans to improve stormwater management, transitioning from five infiltrating test basins to a more comprehensive system. The commission scrutinized the project’s adherence to regulations, emphasizing the importance of maintaining a no-disturbance policy within the critical 25-foot buffer zone. Adjustments to previous designs were discussed, focusing on stormwater treatment systems and erosion control measures.
Further discussions involved a proposed mixed-use development, with details on the construction process and potential environmental impacts. The commission questioned the absence of open spaces and walkways. Concerns about snow storage and its potential to cause erosion were also raised. The development requires a curb cut from MassDOT for access along Route 123, and the commission plans to continue reviewing the project until further progress is made with the planning board.
The commission also addressed two public hearings related to wetland delineations. For File Number 250-1182, the commission confirmed the presence of significant wetland areas, making land use development unlikely due to regulatory constraints. The delineation was accepted without objections. Similarly, for File Number 250-1183, the commission reviewed and closed the hearing after verifying the wetland delineations on Abrew Lane.
Lastly, the commission discussed a proposed project involving adjustments to a parking area, which included removing structures encroaching on a 25-foot no-touch zone and constructing a pocket wetland to enhance local habitat. The commission explored legal implications regarding changes in use and the necessity of obtaining Article 97 approval for alterations affecting public access to designated parkland.
