Totten explained that the modifications made by the applicant aimed to improve the property’s appearance, which included pulling the deck back to the property line and replacing pavers that extended beyond the line with gravel.
The board acknowledged the property’s existing non-compliance issues, including setbacks and floor area ratio discrepancies. Totten emphasized that the proposed changes would not substantially alter these non-compliances but would instead enhance the neighborhood’s visual environment. She argued that other properties in the vicinity featured similar enhancements, such as raised decks and patios.
During the meeting, concerns were raised about parking on the narrow street adjacent to the property. Board members discussed the implications of the applicant’s proposal to move the pavers back to the property line, which would potentially alleviate traffic flow issues. The board also noted that the engineering department would need to approve the materials used in the right-of-way.
Public input was provided by a resident named Carl Hartoff, who supported the variance, stating that the improvements had upgraded the neighborhood and did not impede road access. The board’s counsel followed with assurances that they would confer with the township regarding any road impacts, though they acknowledged their lack of control over township right-of-way decisions.
After deliberation, the board unanimously approved the variance application, which included a zero-foot setback for the deck’s front and rear yard, a landscape area reduction from the required 45% to 4.85%, and the installation of a hot tub in the front yard. Following the conclusion of the Bay View Drive discussion, the board addressed a second application involving Anaen and Razia Hashmi, who sought to legitimize a paver driveway exceeding ordinance limits. The Hashmis explained that they installed the pavers at their neighbors’ request to match the neighborhood’s circular driveways. The board clarified that this application was for a design waiver rather than a variance, as it concerned the driveway’s width, which extended to 73 feet instead of the maximum 30 feet allowed.
Board members noted the driveway’s unique nature in the context of the neighborhood and acknowledged that many surrounding homes featured similar designs. With no public opposition and consensus among the board, the design waiver was unanimously approved, allowing the Hashmis to proceed with the necessary permit filing.
