Old Bridge Zoning Board Rejects Solar Panel Variance, Approves Porch Extension Amid Compliance Concerns
- Meeting Overview:
In a recent meeting of the Old Bridge Township Zoning Board, attention was given to an application for a ground-mounted solar array on Raton Circle, ultimately resulting in the denial of the requested variance due to non-compliance with setback regulations. The board also approved a porch extension for a property on Pacific Boulevard.
The meeting, chaired by James Sullivan, began with the board addressing the application from Brad Nichols, who sought a variance to install a solar array on his property line, deviating from the required 10-foot setback. Nichols explained that the array, already constructed, was positioned only a few inches from the property line. This raised concerns among the board members about adherence to local zoning regulations. The board scrutinized the specifics of the installation, debating whether the existing fence on the property line impacted the setback requirements. Nichols confirmed that the fence was within his property, but confusion arose regarding the appropriate spacing.
The board deliberated on the implications of granting such a variance, emphasizing the importance of maintaining established zoning regulations. One board member noted, “the setback doesn’t go away,” stressing that even with a variance, compliance with zoning ordinances is necessary. The board discussed potential impacts on neighboring properties, highlighting the need for careful consideration before deviating from standard requirements.
With a public hearing yielding no comments, the board proceeded to vote, resulting in a denial of the application with three votes against and one in favor.
Following the solar panel discussion, the board examined an application from Danielle Lafamina, who sought to legitimize unpermitted constructions inherited from the previous homeowner. These included a pool house and driveway encroaching on a utility easement. Lafamina expressed her desire to comply with township regulations, stating, “I wish my husband was here… but we really want to work with the board and the township to just do everything right.”
The board considered the complexities of addressing improvements made without permits, while ensuring current regulations are met. Although a letter from JCPNL approved the driveway’s encroachment, the board remained cautious about granting variances. The application highlighted challenges in rectifying past homeowners’ actions while complying with present-day zoning laws.
The meeting also featured a discussion on a property on Mariposa Place, where the applicant sought a design waiver for a pool house and driveway. The board addressed the need for compliance with building codes and confirmed there was no Homeowners Association involvement. The application was approved unanimously, with board members encouraging the applicant’s community efforts.
Additionally, Melissa Martin’s application for a porch extension on Pacific Boulevard was reviewed. Martin described her porch as deteriorating and expressed her intention to replace it with a new, uncovered porch. The need for a variance arose due to narrow property lines, with the board acknowledging the unique lot sizes in that area of Old Bridge.
The board’s discussions focused on the proposed porch dimensions and compliance with zoning regulations. After confirming the necessary sketches and surveys, the board opened the floor for public comments, which yielded no responses. The motion for Martin’s porch extension received unanimous approval.
