Retailers must also adhere to strict operation hours between 10:00 a.m. and 9:00 p.m. each day.
Temporary cannabis events will follow a model similar to temporary liquor licensing. Event organizers must secure approval from both the Office of Cannabis Management (OCM) and the county. Restrictions include prohibiting smoking or vaping at event venues to prevent secondhand smoke exposure to non-consenting attendees. Violations of the ordinance can result in fines and suspensions, with enforcement primarily the responsibility of the county’s Sheriff’s Office and public health department.
Another point of discussion was the enforcement jurisdiction in municipalities, notably the city of Rochester, which has delegated its enforcement duties to the county. This arrangement requires further clarification between the county and city law enforcement agencies to ensure consistent application of the ordinance.
In other matters, the board addressed zoning concerns related to cannabis retailers’ proximity to areas frequented by children, such as schools, parks, and daycares. These zoning regulations align with state statutes to maintain safe distances.
