- Meeting Overview:
In a recent meeting, the Palatka Special Magistrate focused on several properties with code violations, discussing the city’s enforcement actions, including fines and liens. The property on Kirby Street, owned by Kenneth and Greg Gonzalez, took center stage as the city recommended placing a lien due to accumulated fines exceeding the $10,000 threshold.
The property on Kirby Street was a critical point of discussion as evidence of broken windows, wood decay, and an accumulation of fines reaching $13,800 were presented. The city’s policy of revisiting cases with fines over $10,000 for lien processing was scrutinized, particularly the rationale behind this threshold. The city officials explained that the threshold was a resource management tool to prioritize cases for abatement or foreclosure. They emphasized that the delay in addressing the violations was not intended to increase fines but was an effect of managing limited resources. The Gonzalez property had been in violation for over a year, and despite Mr. Gonzalez’s reported hospitalization, the city was seeking an official lien on the property. However, the special magistrate mentioned that the city would not pursue foreclosure, given that the property was homesteaded. The owner’s representative, Marton Re, conveyed the family’s efforts to comply with city code, but the magistrate clarified that the hearing aimed to ascertain the violation and determine compliance timeframes and potential fines.
Another case involved a property on North Fourth Street, with a roof in disrepair. The city provided photographic evidence and requested a 120-day compliance period for the owner to rectify the issue. The magistrate granted this period, with fines to accrue post-deadline if violations persisted.
At 2119 Oak Street, the city alleged violations for building fronts, mold, mildew, and deteriorating paint. Man-made debris, one of the initial complaints, had been removed, but the remaining issues prompted presentation of photographic evidence and further discussion by the magistrate.
Additional discussions included a property with missing roof soffit and mold and mildew, resulting in a 90-day compliance deadline and a daily fine of $50 for non-compliance. Another case saw a property given 60 days to address mold, mildew, and deteriorating paint, with a $25 daily fine for non-compliance.
The meeting also touched on the efforts to notify owners about property violations, proper permit acquisition, and the city’s decision to place liens on properties with outstanding violations. One debate centered on the correct address for sending notices, highlighting the challenges in ensuring owners are informed of violations.
