Parsippany-Troy Hills Planning Board Approves Pizzeria Site Plan Amid Variances and ADA Compliance Discussions
- Meeting Overview:
In a recent session, Parsippany-Troy Hills Planning Board, during its January 10, 2024 meeting, granted approval to the site plan application by Lake Hawaa Realty LLC for the construction of a deck with facade improvements to establish a pizzeria at the former site of a vacant dry cleaner on North Beverwick Road.
The property, previously a dry cleaner, is undergoing a transformation to become a pizzeria—a change that necessitated a minor site plan with C variances due to the existing structure’s nature. The board examined plans presented by the architect, Mr. Matos, including existing and proposed setbacks, elevations, and the incorporation of a deck in disrepair. Critical to the board’s examination were questions about the deck’s proximity to the property line, the need for a variance for signage, and the feasibility of adjusting the deck’s placement.
The proposed modifications sparked rigorous debate, particularly over whether the deck’s rebuild would classify it as a new structure or a reconstruction, leading to the suggestion of reducing its size by a foot to comply with guidelines. The discussion further extended to the parking situation, where it was ascertained that no dedicated parking would be available, prompting the need for a variance. The topic of ADA compliance was also a focal point, with the board considering the need for a self-opening door and push button to accommodate individuals with disabilities.
During the review, concerns about the accuracy of the plans under scrutiny arose, as the board noted discrepancies between the plans presented in the meeting and those previously reviewed. The board sought assurances that the restaurant’s size, seating capacity, and parking provisions would adhere to township standards. Furthermore, the basement’s exit door received particular attention to determine if it should be labeled as an emergency exit, a question the architect addressed.
The operational aspects of the future pizzeria were also a topic of conversation. The applicant, Joe Ptocz, revealed the intended operating hours and the provision of both dine-in and takeout services. The board inquired about waste disposal, parking, and the applicant’s experience with a similar establishment in Bloomfield, New Jersey.
The public comments were succinct, with the applicant’s representative emphasizing the purchaser’s status as innocent with regards to the pre-existing nonconforming setbacks and parking issues. The representative highlighted the hardships faced by the purchaser and the potential benefit the restaurant could bring to the community.
The meeting was not without its procedural components. At the outset, the reorganization of the board took place, with Mayor James R. Barberio appointing Jennifer Vealey and Michael de Pierro as members of the planning board and Ted Stanziale and Dominic Mele as alternate members. Additionally, Matthew McGrath was appointed as the Town Council Liaison. The board also nominated Tom Dinsmore as chairman and Gordon Meth as vice-chairman, with unanimous approval. Nora Jolie was confirmed as planning board secretary and the minor site plan subcommittee was established, appointing Gordon Meth as chairman and including Jennifer Vealey, Nick Napolitano, Tom Dinsmore, and Dominic Mele.
Professionals were appointed as well, with Christine Winter assuming the role of planner, Andrew Cangiano as engineer, and the law firm of Jacobs and Nikas as the special projects planner.
