Parsippany-Troy Hills Zoning Board Denies Creation of Third Story in Local Home

The board, while sympathetic to the need for additional space, remained firm on the zoning ordinance limitations.
The board suggested that the inclusion of a half bathroom might alleviate concerns about the potential for converting the attic into a living space. However, the applicant’s concession to eliminate the shower did not sway the board’s decision. They stressed that their denial was not of the attic itself but of the inclusion of a full bathroom.
Beyond the denial of the attic conversion, the board approved several other applications with conditions aimed at ensuring compliance with local zoning regulations. One such application, from Tahal Patel, sought approval for an ambitious construction project including a two-story addition, front landing and stairs, driveways, and walkways. The project required variances for front yard setback and building coverage. The deliberation centered on the potential impact of these changes on the property and the surrounding neighborhood. Patel’s application was approved with conditions, taking into account the applicants’ need for more space to accommodate their growing family and improvements to the heating system.
Another approved application involved a request by Sean Wellman for a variance to install a 5-foot fence on a corner lot property. The board considered the necessity of the fence for privacy while addressing concerns about potential obstruction of sight lines for neighbors. Following discussion and with the condition that an engineer would verify the compliance of the fence with respect to sight lines and neighbors, the application was approved.
The board also addressed a proposal for an addition to a house on Flemington Road. The applicant sought to build a garage requiring closer proximity to the property line than currently permitted by zoning laws. The board engaged in a detailed examination of the plans, questioning the distance from the curb, the arrangement of grass and driveway areas, and the design of the existing and proposed kitchens. The lack of detailed architectural plans was a sticking point, prompting the board to advise the applicant to refine the plans with an architect to better address the concerns before moving forward with the application.
Additionally, an application for a shed construction and a roof structure over an existing deck was approved. The applicant explained the need to move the existing shed due to water collection issues and the desire for a larger structure, as well as the intent to provide shade for their deck. Furthermore, a separate application for the construction of a patio, pool house, and stairs was also approved, with the board ensuring the applicant would adhere to stormwater management regulations despite requiring a variance for the height of the pool house and impervious coverage.
The meeting concluded with new members being sworn in, including Loretta Grani as a regular member, and two alternates, adding fresh perspectives to the board.
