The change aimed to facilitate the development of a Minor Rural Subdivision (MRSS), allowing the property to be divided into two lots.
Concerns were raised about the implications of extending utilities over 7,000 feet to the property, questioning whether the utilities department considered the rural area vision in their recommendations. A member of the council asked if there was a plan policy that discouraged extending utilities into the Northeast rural area. Additionally, questions arose about why the developers pursued an MRSS instead of utilizing a one-free split exemption, with Flynn explaining that the size of the property did not qualify for the exemption.
The discussion grew more detailed as an applicant, represented by attorney Lynn Johnson, sought clarity on the necessity of hiring land use attorneys and incurring application fees. Johnson noted that the intention was to split the 41-acre parcel into two lots, each over 20 acres, for residential use. She expressed frustration with the procedural hurdles, stating, “We thought there had to be a simpler way to do this.”
Debate ensued over whether the parcel qualified as a parent parcel eligible for a split and the applicable exemptions given the lot sizes. The council discussed the costs and time associated with the application process, with one member emphasizing, “These proceedings are costly,” and advocating for consideration of the applicant’s situation. The possibility of refunding the application fee if the council had erred was also discussed.
The council agreed to recommend approval of the application, contingent upon a further review of the exemption situation. Following this, the meeting transitioned to another agenda item concerning an LDC amendment to include the 41 acres into the Northeast rural area. This amendment received a motion for approval after a brief discussion.
