Although the original 2018 variance allowed for an 860 square foot accessory structure, the current application proposed an 808 square foot structure, deviating approximately four feet from the initial variance. Black emphasized the substantial investment in the concrete foundation, noting its strength and compliance with size requirements. However, concerns over the legality of the placement and its proximity to a neighbor’s property led to the denial of the application. The board suggested Black consult with the zoning official to explore potential adjustments and the possibility of addressing the issue with his contractor through private litigation.
The meeting also addressed James Bro’s application for a certificate of nonconformity for a three-family dwelling on Rock Avenue. The board approved the application, provided Bro converts the dwelling back to a two-family use by removing the third-floor kitchen and sealing the doorway. This decision was contingent on a deed restriction and subsequent inspection to verify compliance. The board recommended Bro pursue an easement with a neighboring property to ensure proper access to the parking lot.
Another noteworthy application involved Gindo JL Auto Repair, requesting variances for a property historically used as a gas station and automotive service station. The representative highlighted recent improvements, including layout modifications and landscaping, to enhance functionality and appeal. The board approved the application, with conditions limiting the number of vehicles on the property and ensuring any granted easements are promptly recorded.
