Piscataway Zoning Board Approves Critical Variances Amidst Property Challenges
- Meeting Overview:
The Piscataway Township Zoning Board tackled multiple applications during its recent meeting, approving a variety of zoning variances and property modifications that addressed unique challenges faced by local property owners. Notable approvals included a bulk variance for a longstanding garage, the reconstruction of a fire-damaged home, and conditions for a new property owner facing compliance issues.
One significant agenda item was the application concerning a garage initially constructed in 1936, which had collapsed and was rebuilt without proper permits. The property owner, represented by attorney Kevin Morris, sought a bulk variance after the garage’s reconstruction was found to be two feet off the required property line. Morris explained the miscommunication with the contractor and highlighted the owner’s good faith attempt to rectify the situation. He argued that the garage’s historical placement and the unique property conditions warranted a classic C1 hardship variance. The board considered the implications of relocating the garage further into the lot, which would disrupt its intended use. The case was further reviewed with compliance recommendations from the township’s planning report, culminating in the board’s approval of the variance, allowing the garage to remain in its current location.
Another primary focus was the reconstruction of a single-family home on West Fourth Street, which suffered substantial fire damage. The property presented unique challenges due to its undersized dimensions and dual street frontage. The proposed reconstruction aimed to raise the second floor’s roof, improving the headroom and aesthetics while maintaining the existing number of bedrooms. The architect and owner testified to the property’s constraints, including a slanted roof and a retaining wall necessary to counteract erosion. The board acknowledged the property’s long-standing non-conformities and approved the variance, emphasizing that the proposed modifications would not detrimentally affect the neighborhood.
The meeting also addressed the application of a new property owner, Bala Krishna Pata, who sought a certificate of occupancy for a property with an oversized garage and an unpaved driveway. Pata, a first-time homebuyer, cited a lack of guidance from his realtor regarding compliance requirements. The board’s representative highlighted the need for the initial 20 feet of the driveway to be paved, citing potential issues with loose stones. Despite financial constraints, the board insisted on compliance with the 20-foot paving requirement while allowing 90 days for completion. The board also stipulated conditions for the garage’s size and placement should repairs or replacement be necessary, all of which Pata accepted to secure his certificate of occupancy.
In addition to these applications, the board approved a one-year extension for a non-profit organization’s previously approved project, considering the applicant’s ongoing fundraising efforts. The board also approved a bulk variance for Tisha Dailyaly Butler, who requested permission to retain an existing six-foot fence on a corner lot, citing privacy needs and a lack of safety concerns. The board found no opposition from the public and passed the motion through a roll call vote.
