Piscataway Zoning Board Approves Fence with Conditions, Defers Shed Decision
- Meeting Overview:
The Piscataway Township Zoning Board meeting focused on evaluating applications for property modifications, notably approving a fence variance for Terresa and Edward Carr with specific conditions and postponing a decision on Michael Cruz’s fence replacement due to zoning complications with a shed.
The Carrs, long-time residents of Piscataway, sought a variance to erect a six-foot vinyl fence around their backyard, primarily for the safety of their grandchildren and to prevent Lyme disease risks from deer. They proposed a setback of 10 feet from the sidewalk and 18.5 feet from the street, arguing that this configuration would not obstruct driver visibility. However, a board member pointed out that the township ordinance required a 40-foot setback from the property line, presenting a significant reduction in compliance.
Edward Carr attempted to justify the variance by referencing other local properties with fences closer to the street than the ordinance permits, though the legality of these fences was not verifiable by the board. The discussion expanded to include concerns about neighborhood aesthetics, with a board member suggesting that the proposed fence might become an “eyesore” and disrupt the visual landscape. The Carrs contested this description, maintaining that their fence would align with existing neighborhood structures.
The board deliberated over potential compromises, with Edward Carr proposing a 15-foot setback to balance property use with community standards. The board also discussed the fence’s appearance. A consensus emerged that a setback of 15 feet, accompanied by proposed landscaping, would be acceptable. With these conditions, the board voted unanimously to approve the Carrs’ application, with a written memorialization to follow at the next meeting.
The board then addressed Michael Cruz’s application for a fence replacement on Hudson Street. Cruz sought to replace an existing redwood fence to better accommodate his dogs and children. During the discussion, Cruz expressed frustration regarding an aluminum shed on his property, which predated his ownership. A board member suggested additional setback requirements for the new fence, raising concerns about the shed’s visibility if left outside the fence line. Cruz was encouraged to explore alternative landscaping options to screen the shed.
The board decided to table Cruz’s application, allowing time for him to consult with township staff on potential solutions. The application will be revisited at a future meeting.
Following Cruz’s case, the board reviewed an application from Sean Ali, who sought approval for a fence encroaching upon a utility easement. With no public opposition, the board approved Ali’s application unanimously, with written memorialization to occur at the next meeting.
