The board was asked to accept jurisdiction over the case, and after thorough deliberation, it was decided to grant the variances.
Julianne Akuna testified that she and her husband had hired a contractor during the COVID-19 pandemic, assuming all necessary permits were being handled. However, a notice of violation from the zoning officer revealed otherwise. The variances requested were due to several non-compliant issues: the driveway encroached on the required side yard setback, the patio exceeded maximum lot coverage, and the deck and shed did not meet setback requirements. The board scrutinized these elements, noting that the driveway extended to the property line, where a five-foot setback was required, and the impervious coverage was at 54%, exceeding the 45% allowable limit.
The board’s approval of the variances was unanimous.
Another application was presented by Javanni Balsamo and Shannon Aado for a new garage on Orchard Street. The couple explained their need for additional storage space at their home, specifically for classic vehicles and bicycles. They proposed constructing a 24 by 30-foot garage for personal use only, with no intention of adding plumbing or engaging in commercial activities. The board questioned the garage’s height and access arrangements, confirming two aprons were already in place. The application also required clarification regarding the proximity to the property line, which was corrected during the meeting. With no public objections, the board approved the application unanimously, allowing the couple to proceed with obtaining construction permits.
The board also addressed resolutions for previous applications, including those for properties on ID Wild Avenue, Martin Street, Carney Avenue, and Melrose Avenue, all of which were approved unanimously. These approvals were routine, yet they emphasized the board’s ongoing work in ensuring zoning compliance throughout the borough.
In procedural matters, the board approved the minutes from the previous month’s meeting and discussed the schedule for the upcoming year’s meetings. It was decided that the reorganization meeting in January would commence at a later time of 7:30 PM, a change agreed upon by all members.
