The most discussion centered on a setback variance application by Sharper Homes Incorporated. The company sought to reduce the front yard setback for a septic drain field from 10 feet to 8 feet and to decrease the setback from the ordinary high water level from 75 feet to 61.5 feet. The proposed attached patio slab on Edmar Lane Northeast was the main subject of concern. The property, notable for its 64-acre size and location within the Lake zoning district, posed unique challenges due to nearby wetlands and city-owned lowlands.
City staff presented a analysis, emphasizing that economic considerations alone did not justify a variance. They applied a three-factor test to determine the appropriateness of the variance, focusing on reasonableness, uniqueness, and neighborhood impact. They concluded that the setback variance was reasonable, considering the property’s unique issues, and noted that other area properties also had visible septic systems.
During the public hearing, only a representative from Sharper Homes stood to comment, expressing support for the application. Commissioners, in their discussion, acknowledged the necessity of the septic system for residential use and noted that the property’s unique characteristics warranted the variance. Questions arose regarding the role of the Department of Natural Resources (DNR) in the approval process, with the commission noting that though the DNR had been notified, no response had been received.
Another notable discussion revolved around a variance request from Josh Belfy for a second driveway at 19408 East Front Boulevard Northeast. The triangular property, situated within a Lake zoning district, presented challenges due to its layout and the positioning of its septic drain field and well. The city code typically allows only one access point to public streets, but Belfy’s request highlighted the practical difficulties posed by his property’s unique configuration.
City staff explained that several properties in the vicinity had second driveways predating a 2008 ordinance which restricted such access. Belfy argued that a second driveway primarily for accessing a newly constructed detached accessory structure would not disrupt the neighborhood’s character. He proposed using recycled asphalt millings instead of concrete for the driveway, citing potential damage from heavy equipment like a skid steer.
The Planning Commission engaged in a technical discussion on the imperviousness of millings, with differing opinions on whether the material would retain its pervious quality over time. Concerns arose about loose materials potentially impacting roadways, with some members advocating for a minimum impervious surface at the road to prevent debris.
A representative clarified past City Council decisions on similar variance requests, noting that conditions could be imposed to require asphalt if road base issues arose. Ultimately, the motion to recommend approval for the driveway variance passed, albeit with a single dissenting vote, allowing discretion on surface material to the property owner.
In related matters, the Commission approved the reappointments of Sharon Johnson and Brian Downie and acknowledged Commissioner Gabe Hansen’s decision not to seek reappointment due to personal commitments. Hansen expressed hope to return in the future. His impending departure will see the Commission advertising for a replacement post-Thanksgiving, with interviews slated for January.
