Despite the contention, the board eventually moved to approve a decision on the matter.
Another focal point of the meeting was the discussion about the St. Road subdivision plan and stormwater management permit application. The developer provided updates on the construction progress, including mailboxes, phasing, and open space details. A crucial aspect of the discussion was whether the proposed bio-retention basins, intended to be planted with wildflower meadows, could be included in the open space calculation, especially since the open space was slightly below the required 10%. Board members scrutinized the functionality and visual aspects of the basins, as well as the necessity for fencing, to which the developer clarified that the basins would be dry, shallow, and not require fencing.
The board also explored the implementation of a cistern system, following National Fire Protection Association guidelines. Concerns were raised about the permit timing and the system’s capacity, alongside discussions on the maintenance of the road within the development.
Regulating the maintenance of development systems post-completion was a topic of concern. The board stressed the need for a clear maintenance plan, emphasizing that neither the town nor the fire department should be responsible. There were discussions about potential issues arising from the lack of a homeowners association, and the necessity for ongoing inspections and annual testing.
The comprehensive zoning review by the Pioneer Valley Planning Commission also took a central stage. The review aimed to update the zoning bylaws to align with Massachusetts General Law, the town’s master plan, and to improve clarity and readability. The board considered the zoning bylaw’s impact on open space preservation, non-motorized transportation, and transit options. A specific concern was the clarity of language regarding the large-scale raising of farm animals.
Further, the board discussed the draft zoning bylaw. Topics such as the Adult Entertainment District, multifamily residential units, accessory dwelling units, parking requirements, and the inclusion of solar and battery provisions were examined. The board debated the intent and implementation of zoning regulations, showing the complex nature of the review process.
Regarding regulatory amendments, the board discussed refining the business restricted zone to encourage low-impact development in the Village Center and considered subdivision rules and the protection of scenic vistas. An application for replacing signage at a local CVS Pharmacy and a new roof sign at another location were discussed, with both receiving positive recommendations.
The planning board also addressed the topic of a proposal for 71 College Highway, debating the preservation and retention of open space and establishing operating hours for a new business, focusing on delivery and stocking times.
